Jason Simcisko Takes Prize For Lying in the Penn State Perjury Scandal

Meet a perjurer — Jason Michael Simcisko, 37.

I will have more to write about him and the other conspirators in the Sandusky “Perjury for Cash” case.

I will prepare a white paper for federal authorities to investigate this matter, just as I did for NXIVM, and will keep readers updated on the progress, including when arrests will be made.

Remember, because this is a conspiracy with ongoing racketeering predicate acts, the enterprise that began in 2008 with Dawn Fisher Hennesey and Mike Gillum is not time-barred from prosecution.

But today, we are looking at enterprise member Jason Simcisko, born on January 1, 1987, who grew up in Moshannon, Pennsylvania, north of State College,

There is ample evidence that Simcisko conspired with Dustin Stuble, Zach Konstas, Ryan Rittmeyer, Michal Kajak, and Brett Swisher Houtz to defraud Penn State out of millions.

These members of the enterprise got:

  • Jason Simcisko: $7,250,000.00 (Attorney Matthew A. Casey)
  • Brett Swisher Houtz: $7,250,000.00 (Attorney Benjamin D. Andreozzi)
  • Michal Kajak: $8,100,000.00 (Attorney Thomas R. Kline)
  • Zachary Konstas: $1,500,000.00 (Attorney Kenneth M. Suggs)
  • Dustin Struble: $3,250,000.00 (Attorney Matthew A. Casey)

It is funny, but the dummy Struble, who recruited Simcisko into the enterprise for Attorneys Matt Casey, Joel Feller, and Andrew Shubin, was too stupid to adjust his perjury to maximize the financial benefits of their fraud.

In another story, we will address more of Simcisko, Struble’s and the other clients of Shubin/Casey and Feller’s highly calibrated stories.

For now, consider this pattern. All the conspirators began by saying Sandusky did not abuse them. All of them changed their stories to abuse in the grand jury, calibrated it for the trial, and finally recalibrated again for what they thought would be a confidential settlement document with Penn State.

This is newly discovered evidence, because the Penn State documents were previously hidden from the public. They prove the fraud and racketeering.

So, let’s use the devious and disgusting Jason Simcisko as an example.

Story #1

On July 19, 2011, PA State Police questioned Simcisko in their manhunt-style search for Sandusky victims. Like hundreds of other young men who had been helped by Sandusky or his charity Second Mile, Simcisko, 24, told police Sandusky never did anything inappropriate to him when he knew him a decade earlier as a teen whom he mentored.

According to the police report, Simcisko said,

“I lost touch with him (Sandusky) around the time I went into 10th grade. I was in trouble a lot then; in and out of foster homes and stuff. He made me feel special, giving me stuff and spending time with me. I just always took it that he was trying to make sure I kept out of trouble. I don’t believe any of this stuff is true and hope that he’s found not guilty.”

Within a few days, Simcisko met with lawyer Andrew Shubin and retained him.

Shubin was already representing Simcisko’s friend Dustin Struble, and would soon represent Ryan Rittmeyer and cowardly USMC Sergeant Allan Myers.

Story #2

After meeting with his attorney, Simcisko testified in the grand jury on August 18, 2011, that he had stayed overnight at Sandusky’s house around 25 times.

 

He also went to the Penn State gym to work out with Sandusky, who wanted to train the troubled teen in mind and body. After the workouts, they would shower in the locker room, he said.

The grand jury minutes read:

“Sandusky initiated physical contact in the shower with Victim 3 (Simcisko) by patting him, rubbing his shoulders, washing his hair and giving him bear hugs. These hugs would be both face to face and with Sandusky’s chest to Victim 3’s back. Victim 3 said that on at least one occasion, Sandusky had an erection when he bear hugged Victim 3 from behind.

“He also recalled that when he slept over at Sandusky’s residence, he slept in the basement bedroom. He testified that Sandusky would come into the bedroom where he was lying down. He sometimes said he was going to give Victim 3 a shoulder rub; sometimes he would blow on Victim 3’s stomach; other times he tickled Victim 3. Sandusky would rub the inside of Victim 3’s thigh when he tickled him. On two occasions Victim 3 recalls that Sandusky touched Victim 3’s genitals through the athletic shorts Victim 3 wore to bed. Victim 3 would roll over on his stomach to prevent Sandusky from touching his genitals.”

In the grand jury, Simcisko said Sandusky hugged him in the shower with an erection and, at his home, he touched his genitals twice through his shorts.

Story #3 – The Trial

Between Story #1 and the trial, Simcisko had six coaching lessons with his lawyer, Shubin, a fact he admitted at trial.

Changes between grand jury and trial stories: His alleged abuse happened in two locations, in the shower room at Penn State and in the basement of Sandusky’s home.

Simcisko added some new touches to the locker room showers, which he admitted occurred only a few times after workouts.

In his new version, Sandusky had taken to washing Simcisko’s buttocks for him.

And the bear hugs from Story #2 stayed, but this time, Sandusky threw the 13-14-year-old up in the air.

“He would pick me up and bear hug me, like give me a real bear hug, while tossing me in the air both with my back to him and my front to him, that’s all I can recall.”

He was asked. “Did you tell your mom or anybody else what he was doing?”

As for the overnight visits, Simcisko doubled the times he stayed at Sandusky’s home to 50 overnight stays.

He kept the part in Story #2 where Sandusky “would start rubbing my stomach, blowing on my stomach and pelvis. He would also, at times, he would touch my penis” over his clothes.

But in Story #3, Simcisko added a nice touch, “He would kiss my shoulders.”

When asked, “Did he touch any other parts of your body?”

Simcisko said, “No, not that I recall.”

Then he added a new factor that must have taken some persuading by Shubin to get him to say.

Simcisko testified: “He touched my penis …he would touch me and rub me and grabbed me, and he gave me an erection, and at that time, I would roll over and try to get it away from him, and that’s, that’s pretty much where it would stop. I wouldn’t let it go any further.”

Q: Did you ever tell him, ‘Don’t get in bed with me or anything like that?

A: No.

Q: Had you ever told anybody that Mr. Sandusky had inappropriate contact with you?

A: No

Q: And during those 50 or so times … did Mr. Sandusky ever ask you to perform oral sex on him?

A : No.

Q : Did he ever perform oral sex on you?

A : No.

Story #4

Right after the trial, with Sandusky convicted, Simcisko’s attorneys filed a “confidential intake form” with Penn State.

Simcisko’s attorneys submitted oy with the understanding that Penn State’s money was there for the taking.

Shubin understood Ira Lubert was requiring his clients to have a Philadelphia lawyer who could do Lubert a good turn one day with a judge or politician.

Shubin knew how the law works in Pennsylvania (and many other places). He partnered with Matt Casey, brother of Senator Bob Casey, and his partner Joel Feller.

This way, the claims would not be vetted. Lubert was a man known for needing things, and he was not averse to using Penn State money to buy a little goodwill or influence.

Simcisko ‘s Penn State story had some nice new touches as he and his lawyers continued to work on it to improve it.

First, they came up with something brand new:

Sandusky took Mr. Simcisko on overnight trips in Sandusky’s car where Sandusky repeatedly “placed his hand under Mr. Simcisko’s waistband and fondled Mr. Simcisko’s genitals.”

At trial, Simcisko said Sandusky only touched his penis over his clothes when he had stayed overnight. That changed.

“Sandusky regularly and routinely-coaxed Mr. Simcisko to… strip down naked and touched Mr. Simcisko’s penis until he had an erection.”

No longer did Simcisko “roll over and try to get it away from him… and not let it go any further,” as he had testified.

In Story #4, “Sandusky got into bed with Mr. Simcisko and pressed his erect penis against Mr. Simcisko’s back and buttocks, kissed his stomach, and tickled him.”

At trial, Simcisko said he thought of Sandusky as a father. Now, he shifted the story to a different kind of relationship.

The intake statement reads, “Sandusky’s sexual abuse of Mr. Simcisko made Mr. Simcisko feel as if he was Sandusky’s ‘girlfriend.'”

As a classic finishing touch, we note the difference between the severity of the abuse between the trial version and the Penn State version.

At trial, Simcisko said Sandusky never performed oral sex, and the abuse went no farther than the touching.

In his effort to successfully defraud Penn State, Simcisko’s lawyers claimed to Penn State:

“Sandusky required Mr. Simcisko to shower naked with him in Penn State athletic facilities.  In the shower, Sandusky would… press his erect penis against Mr. Simcisko from behind in what Sandusky called a ‘bear hug.’

“Then Sandusky penetrated Mr. Simcisko’s anus with his penis and forced Mr. Simcisko to engage in oral sex with him.”

Penn State paid Jason Simcisko $7.25 million for his abuse in a settlement, without even asking the 26-year-old man a single question.

Excellen fact-finding and reporting on this judicial travesty. And, it has taken a mere four months to move this to where we are now. Justice for Jerry will soon become a movement. I suspect that soon the mainstream media will simply have to begin to pay attention to this greater scandal. When that happens, buckle up folks, it will be quite a ride.
As to who I would like to see fall the fastest and greatest is none other than the local ambulance-chasing attorney Andrew Shubin. I shall travel hundreds of miles to attend the entirety of his trial.
But first, there remains much work to do. Do not lose your focus. Share Frank’s excellent, penetrating investigation and reporting with the American people. Become an activist for an innocent human being and against an ever-growing corrupted judicial system.

As the old saying goes, “Keep the pedal to the metal.” Don’t stop until these criminal miscreants’ (attorneys, judges, therapists, trustees, et.al.) heads roll and go to prison. As I said in an earlier email, I’ve known Jerry Sandusky for 70 years and there is no way on God’s earth that he committed the crimes for which he was falsely convicted and imprisoned…NO WAY!

Frank, these articles just keep getting better. “False accusers, unethical prosecutors, shyster lawyers, quack therapists, lying cops, reckless reporters, biased judges, vengeful politicians, and cowardly Penn State trustees will be known for their misdeeds.” That sums up the entirety of the real criminals in this case, but I think you went too lightly on the judges. Elected in the state of PA and trusted to be the arbiters of justice and reason, Judge John Cleland and Judge Maureen Skerda have repeatedly ignored or outright trampled on Sandusky’s constitutional rights. Their day will come.

Since these ‘victims’ believed they would never be found out and that somehow they were ‘protected,’ they embellished their stories with no shame or conscience. These so-called ‘victims’ are disgusting as are the board, police, attorneys, judges, therapists, etc. Everything about this case is reprehensible – and thanks to the players people ACTUALLY believe this BS.

If Mrs Sandusky would call me right now. And She would know who I’d be and show me the sex tape that Bruce Heim said was floating around. I’d take a poly test. I knew of two teachers in grade school that were husband n wife on music and another just a kindergarten teach that adopted brother n sister then lost custody of them for abuse in the 81to 83 lived close by. IMO, The now broke fake victims who used fake therapists to fake remember crimes, are the ones who will come forward. They’ll completely get off because they can easily blame everything on the quack therapists and grubby attorneys.

And they can make some more money on the back end with book deals etc. Add in feeling good for finally coming clean, and it’s a no brainer for some of them.

Playing offense is better than playing defense and Frank currently has these liars on the run. One of them should call Frank and start playing offense.

Yes, the police and also the prosecutors such as McGettigan were very fair. Press reports show them trying to ring-fence Shubin’s influence from any criminal proceedings. Also, even the grand jury presentment is fair. I remember, police also testified carefuly about how they interviewed 600 second-mile kids who said that Jerry S was innocent.

The issue is that the jury wasn’t careful, they didn’t think things through.

I sometimes think something similar when someone is freed after 30 years by re-testing the evidence for DNA. If you think about it, that means that some careful policeman dutifully curated the evidence for 30 years and never discarded it in case there might ever be an appeal. Then the police are the ‘bad guys’ when DNA evidence clears the suspect. People who allege sexual assault deserve to have their cases heard, there is a responsibility to both sides of a case.

In this case, it is absolutely, 100% proven that this was a miscarriage of justice. If you even read the original trial transcript you will see also that the jury findings were anomalous, the case was not proven. Some press reports tried to explain things like how showering together without clothing after sports was really normal and not sexual for an older generation. And the totally unrelated issue that someone who has cared for, fostered, and adopted many kids with physical and intellectual disabilities should be expected to be affectionate at home, sympathetic in cases of devastating loss.

Barden said, in cases like this, the interviews all should have been tape-recorded. Also the jury should have understood the timescales over which the witness statements evolved. The lawyer Amendola should have focussed on how the agreed facts of the case, agreed between Sandusky, his wife, all his colleagues and friends and all the witnesses and all the various social workers, about what types of intimacy did happen, were all consistently describing very appropriate intimacy, and the divergences from that were absolutely outlandish in contradictory directions.

I think the reason Amendola chose to advise Jerry Sandusky to waive the preliminry hearing is that he was afraid that once the witnesses met, there is nothing to stop them copying each others’ stories.

Wow! I can’t really decide which of these “alleged” victims is the worst liar. A good actor can memorize his/her lines in a play or at least be able to read a card with his/her lines printed out right in front of them. Although we don’t have a Pacino or Di Niro among this group of actors, they pulled off the greatest performances of their lives and instead of a little statue for their efforts, they got cash. As they received their monetary awards, they should have said, “I’d like to thank my acting coach, I mean my attorney, for helping me prepare for my performance!” No, I still can’t decide which of these frauds is the worst of the lot. All the votes have not been counted yet, so please register your favorite fraudster for consideration.
