As we continue our evaluation of Keith Raniere’s 2255 motion to vacate his conviction based on ineffective assistance of counsel, we turn to another failure he alleges his counsel made:
Counsel Was Constitutionally Ineffective For Failing To Challenge The Illegal Search And Seizure Of Evidence
Raniere says his defense team should have challenged the illegal search and seizure of Raniere’s library at 8 Hale.
RAniere, who at the time he filed his motion, represented himself, pro se, writes, “the government illegally obtained, manipulated, and staged evidence in this case…” and his defense “counsel entirely failed to raise” an objection.

Raniere maintains his Fourth Amendment rights were “egregiously violated” during the FBI search of 8 Hale Dr. in Halfmoon, NY on March 27, 2018.
“The actions taken during this search not only defy the principles of lawful investigation but also undermine the integrity of our justice system,” Raniere wrote.
Because Raniere’s counsel failed to “challenge these egregious actions by the government in the search and seizure,” Raniere writes his “§ 2255 motion is due to be granted.”
If he is right, Raniere scampers out of prison.

Raniere explains what the FBI did:
The FBI’s photos of the evidence, which the US Attorney used as trial evidence, “demonstrate,” according to Raniere, “that FBI agents engaged in illegal conduct by staging evidence, falsifying search photos, and planting evidence.”
Exclusionary Rule
He points to the “exclusionary rule,” which is that evidence obtained through illegal means should be inadmissible in court. But, Raniere points out, it only works “if counsel had raised such a challenge.”
The Supreme Court established that the exclusionary rule is meant to deter future unlawful police conduct.
Ranire argues: “This principle is … a cornerstone of our legal system’s commitment to justice and the rule of law. Any defense lawyer who ignores this cornerstone provides ineffective assistance of counsel.”
Raniere writes that in criminal trials, “the Court has consistently found the exclusionary rule to be efficacious in deterring improper police conduct and protecting Fourth Amendment rights, as evidenced by landmark cases such as Elkins v. United States (1960), Mapp v. Ohio (1961), and Weeks v. United States (1914). “
In this case, the allegedly illegally obtained evidence includes a Canon camera, memory card, and Western Digital hard drive.

“These items were at the heart of the prosecution’s case, purportedly substantiating Racketeering Acts 2-4. However, given the tainted manner in which this evidence was procured, it, and all evidence seized, must be excluded, ” Raniere argues.
In our next post, we will explain Raniere’s evidence that the FBI staged the evidence, and how the FBI photos taken during the raid prove it.
He says. “According to a report by a former FBI expert who evaluated the evidence in this case, it was obvious that evidence in the search had been illegally staged, planted, manipulated, and the search was ‘not legitimate.'”

It is deplorable what Keith Raniere was able to do these poor girls. I don’t think that it was enough to also convict Alison Mack. There were more people involved in helping him sexually abuse his prey. This type of group facilitation also commonly exists in family court. Private attorneys and therapists are given leeway to do whatever they want, including preventing emergency screenings after a child has confirmed being sexually abused. It happened to my kids. An attorney, Valerie Houghton, is forcing my kids to live with sexual abuse. She doesn’t care that the youngest was just two when the abuse began or that my eldest son is now suicidal. These people have zero empathy.

Prosecutors love these big and important cases where, as in the Raniere case, the burden of proof is so overwhelming that it’s an easy game to win the case hands down if you don’t make any mistakes. They offer the prosecutor the opportunity to distinguish himself and recommend himself for other significant tasks or a better-paying job, and they are highly regarded by the media. It is an advantage if the show runs for 6 weeks so that the trial is covered long enough, and you don’t go back to business as usual so quickly. You stay in people’s minds for longer and do good public relations. Raniere has done a good job with all this, without meaning to. But it has also hurt him enormously. He and his lawyers probably didn’t realize that or ignored it. For Raniere, the whole process was the worst PR imaginable. But he decided that himself.

A name with many syllables is also not good, or names that consist of several words are bad. Names that we don’t know or can’t pronounce are also bad. Names that we cannot tell whether they belong to the first name or the surname are also bad. Names that exceed the length of an average sentence are also unfavorable. And Names that elicit negative connotations or render one an embarrassment are also detrimental. Make a list. Maybe names that only consist of one letter are also bad. But I still have to find out.

When Star Trek: Discovery debuts on CBS All Access in May 2017, the franchise will return to television for the first time since Enterprise’s cancelation 12 years ago. The show will be set in 2255, a year after the first The Original Series pilot, “The Cage,” and a decade before the second, “Where No Man Has Gone Before.” Little is known about the premise, but during a 2016 Television Critics Association panel, Bryan Fuller, Discovery‘s original showrunner, announced that the first season would incorporate “an incident in the history of Starfleet that had been talked about [during the 1960s TV series] but never fully explored.”
That got fans talking. In Star Trek’s fictional history, only two significant events to date have been set in 2255. The first is the signing of the Treaty of Armens, from The Next Generation‘s “The Ensigns of Command,” which ceded several Federation planets to the Sheliak, while the other is James T. Kirk’s first planetary mission to the planet Neural. It remains to be seen what Fuller meant with his comment—but while we wait to find out, let’s examine the status of the Trek universe in 2255. We have no idea what the show’s premise will be, but we do know a great deal about the universe in which it will take place.

I sometimes wonder what happened to him for his neuroses to play out in such a destructive, devastating and depraved way. I remember reading from one of the women who knew him in his pre Vanguard days mentioning she always got the sense Keith was hiding something dark about himself. He must have experienced something deeply traumatic in his childhood that he probably bottled up and made his victims a proxy for whoever hurt him.

It seems like KR has low self-esteem and a sense of entitlement from being spoiled and praised in lieu of genuine love. He never put effort into becoming the concert pianist he probably wanted to become because any minor failure threatened his precarious sense of self and therefore effort became “painful.” His feelings of injustice and victimization might originate from a very real experience of betrayal.
If Sadistic PD was still a valid diagnosis, he’d probably be diagnosed with it. He’s too limbic and outwardly emotionally controlled to be a full-blown psychopath, at least the way it’s defined in the research literature. The difference between an antisocial and emotionally sadistic person is in the background, with clinical psychopaths having a significant history of physical abuse or violence while sadists differentially but significantly demonstrated an alarming rate of female-perpetrated sexual abuse in adolescence, mostly by the biological mother.
I wonder now whether it was his mother who wounded him? It would make sense that sustaining such a deep emotional injury like being betrayed by one’s mom would leave a person who seemingly had it all (millions at his disposal, adoring followers, a bevy of female admirers, good education) still so unhappy and unable to fill some gaping hole inside of him. Nothing could ever be enough for Keith, hunger with no means of being satiated, and, unfortunately, he grew up in a time where resources to help him cope and potentially heal from his pain weren’t readily accessible.
But I imagine some experiences, especially recovering from a mother’s betrayal, might not respond to treatment efforts. Some heartbreaks are so devastating the broken remnants cannot be pieced back together. Either way, nothing warranted the extensive psychological suffering and torment he caused so many people.
