Federal prisoner Keith Raniere wrote a 200-plus page Ineffective Assistance of Counsel Motion for a new trial, which Frank Report is reviewing in a series. One of his many arguments concerns his ejection from Mexico on March 26, 2018.
Known to followers as Vanguard, Raniere was enjoying a retreat at a seaside villa known as Casa Chocolate, located in Chacala, within the municipality of Compostela, Nayarit, when on a day of infamy – or for some, “the day of most joy” – the afternoon of March 25, 2018 – armed men with rather loutish countenances, dressed in Mexican Federales uniforms, appeared without an invitation, claiming Raniere, a resident of the United States, had not verified his regular residency status in Mexico.
In other words, a visa check.
Raniere says it was a ruse. The Mexican authorities knew he had a valid visa, he said in his motion.
They were there to apprehend him, aware of a US arrest warrant charging Raniere with federal sex trafficking, conspiracy to commit sex trafficking, and forced labor.
After Raniere emerged from a closet he was hiding in, the Federales laid hands on him, escorted him to their vehicle, and whisked him away.
Raniere says this operation was not prompted by any violation of Mexican law, but was an “an illegal extradition, breaching the bilateral US-Mexico Extradition Treaty.”
After the Mexicans snatched the man known in his community as its ethicist, they kept him overnight, photographed him, got him to admit they did not ill treat him.
In the morning, they told him he was leaving on a jet plane. The US DOJ paid for his transportation back. He traveled by air, on American airlines, to Dallas, where, upon arrival, FBI agents placed handcuffs on him. This was a wise precaution that prevented the former East Coast Judo champion from reducing the agents to a whimpering, supine, immobility, and shackles on his legs meant to limit his lordly but square-footed steps. This was doubly wise. Raniere had informed his followers that he once tied the NY state record for the 100-yard dash.
Conspiracy to Get Him to US
Raniere was arrested in the US six years ago. He has not experienced a moment of freedom since he was forced to return to his native land.
He argues he was in Mexico legally. Mexico did not charge him with violating any laws that might warrant deportation. But both the US and Mexican governments represented his ejection from Mexico as “a deportation.”
Raniere says to be deported, someone with a legal visa must do something wrong in the country they visit – i.e., Mexico.
Extradition is different. It occurs when a person is alleged to have done something wrong in another jurisdiction, such as the US, and the authorities in that country go through a formal process with the jurisdiction where the individual lives lawfully, such as Mexico, to secure the suspected wrongdoer’s custody.
Raniere says the “transfer operation, devoid of formal extradition proceedings and treaty adherence, constituted an illegal extradition.”
Get Me Out of Jail
Raniere says US District Court Judge Nicholas G. Garaufis must vacate his conviction based on the US-Mexico Extradition Treaty, which provides US citizens with due process guarantees. This was “a breach of the good faith required in upholding international treaties, as per the Vienna Convention.”
It gets worse, according to Vanguard.
The US illegally extradited him based on sex trafficking and forced labor charges. After he returned to the US, the DOJ charged him with racketeering, which, he says, “contravenes the Rule of Specialty, which restricts trial offenses to those explicitly stated in the extradition request or those closely related.”
He cites a 19th-century case, United States v. Rauscher, which holds that a defendant brought back to the United States via an extradition treaty can only face the charges cited in the extradition order, and any later charges must be dismissed.
But it gets even worse, Raniere says.
The prosecutors deliberately lied about the snatching of the Vanguard, telling the court that it was a deportation when they knew it was an (illegal) extradition. And this isn’t just old news. Vanguard calls it “newly discovered evidence.”
It wasn’t until three years after his conviction that his lawyers finally got his immigration file through the Mexican government. In a word, Raniere argues that his “illegal extradition,” which led to “a violation of the Rule of Specialty,” is “newly discovered evidence,” which is part of his “Ineffective Assistance of Counsel” motion.
Since you and I and everyone else we know were not listed in the 1989 Australian edition of the Guinness Book of Records for having the highest score on a IQ, even if the test was a take-home test, it is understandable that we won’t immediately understand how this deportation vs. extradition issue somehow led to his lawyers failing him.
But in our next post, we will allow the Vanguard himself to explain it to us.

Why would Raniere need a visa? American citizen don’t need a visa to be in Mexico if they have a passport unless they are there for business.
Raniere didn’t own a business. Nothing in NXIVM was in his name. Remember, thing yet showed up for him? Gifted by his followers.
Unless one plans to be in Mexico over 180 days you don’t have to apply for a visa. Raniere had only been there a short while. He was there for a group blow job & to hang out with his closest DOS gals.
He knew the FBI was looking for him. They left they business card with some followers close by where Raniere had been staying with his baby mama & son.
It’s probably when he got the advice to apply for a visa thinking it would help him with the local officials.
Not the Mexican Federal police. They didn’t have to check in with the local police who had might have connections with the weathly Mexican NXIVM members.
A visa doesn’t give anyone democratic immunity. Not even Clare Bronfman money could buy Raniere that in Mexico.
It’s a matter of days or weeks and this motion will be DENIED

The timing of this is interesting, given that his April 22nd date to finalize the big “nope” from the judge was the same day this was filed. Everyone sees this for the game that it is, and very obviously his sentencing did not deter the terrorism by litigation that he is known for. He has to do this because his moronic brain can’t handle it being finally over and the world forgetting about him (we are all waiting for that day). Also interesting that it around the time horseface gets some freedom, so he’s likely freaking out about that too. I’m no expert in Mexican/American extradition/deportation law. My gut feeling tells me this a far fetched argument. Even if there were minor irregularities, or larger ones for that matter, they will not free Keith.
I do believe that due process is important, but at the same time I don’t want hardened criminals walk away free because of some minor irregularities in the prosecution.

Some fatal issues with this argument from Raniere’s motion: The Geneva Convention protects individuals during wartime which doesn’t apply here; individuals are seldom granted standing to invoke international treaties which he is trying to do; finally, in the rare case where a court might find an extradition to be unlawful and orders a person released, they are simply rearrested as they walk out the jail doors. It happens all the time with intrastate extradition violations or where someone is arrested on an invalid arrest warrant. The court strikes the legal instrument that got the person before it and orders the person released but that doesn’t excuse the person from being present in that jurisdiction when released from custody hence the rearrest. This is a lose, lose, lose for Raniere.
That this nuance of his departure from Mexico lends itself to an ineffective counsel argument. For someone supposedly so smart, he’s very dumb. This is very similar to the camera card nothing burger and the outcome will be identical: DENIED
The Rule of Specialty argument has some merit. DOJ initially had to drop campaign finance charges against Sam Bankman-Fried because the extradition warrant presented to Bahamian authorities neglected to include those specific alleged crimes. DOJ’s remedy was to prepare a second indictment and move for a separate trial on campaign finance and bribery charges, though they eventually opted to abandon that plan.
Raniere was deported to the United States by Mexican authorities. A valid tourist visa is not an obstacle to deportation. An extradition request is not necessary. Raniere entered the country on a Mexican tourist visa with temporary residency rights. He did not have Mexican citizenship or a permanent residence permit. The actions of the Mexican authorities were therefore lawful and do not require U.S. law enforcement to drop certain charges or not to file charges at all.

I do agree with Jack Rabbit. If there was fuckery involved in the process of getting Kieth from Mexico to Texas, to NY, then civil remedies should be in place to correct the wrongs.
Throughout the trial, I thought Kieth would get 8-10 years, not 120. Although, with child porn pics, I kinda get it. That is pretty grimy. I believe 10-12 would be appropriate. I do believe the punishment should fit the crime. A guy I grew up with had child porn, like 1000 images or something like that. He got 5 years in Federal Prison. But then again, he did not produce it, he just downloaded it. He is a dirtbag.

I thought 15 years was about right for a plea agreement. It’s would have been a significant penalty that wouldn’t have minimized the severity of his actions. Is there any information what the prosecution offered? I can’t recall Agnifilo commenting on that.
Since he did not take accountability nor express contrition in a sincere way, the judge put him away for life. It’s severe but Raniere needed to reflect and accept the damage he caused to people.

Technically, he is right. He was not deported for cause, he was illegally extradited without a formal procedure conducted by the Mexican and US governments. If what says is true, it took till 3 years after trial to get his visa folder from Mexico, that’s significant. Even more so, a violation of the rule of specialty.
I got plenty reasons to dislike Raniere, but I believe rendering someone illegally from another country, lying about it and with-holding information about it is not the way to do it.This case stinks. Raniere is an abusive, manipulative psychopath but so are a lot of people that are not serving 120 years in prison.
So, Frank. You’re powerful. You’re friends with the right people. Go Get your sworn enemy out of jail, just for the principle of it.
