An evidentiary hearing will hopefully reveal if there is any criminal offense rather than just an extremely unethical practice that virtually insured an unfair trial, in my opinion.

Did Jerry not know – even after being told- that he was not to shower naked with young boys? With young teens?

Let’s stop the nonsense that Jerry was from a different generation and didn’t know better- it’s an insult to real men of his generation who would never consider this conduct.

Hi Frank,

My first reaction here, I’ll take a few weeks to read everything new and try to understand it.

The financial misdeeds of Joe Mcgettigan are believable, people do need to make money and we all know ways that we cheat. I let my kid drive the old 1997 volvo, knowing it’s burning a lot of carbon, or we take plane flights on ets knowing that is even so much worse.

Not jointly interviewing Marie and her son could have been out of correct ethics to avoid the type of prosecutorial misconduct that happened so much with other witnesses.

The last two, who came in through the hotline, obviously were saying insane things — and McGettigan and others would know the stories were wild and inconsistent.

When the jury convicted, I can even imagine a lot of people on both sides saying ‘screw this, I’m outta here.’ Getting rich from the 100 millions of Penn State money is the natural next step.

Cocaine isn’t really a hard drug …. but my main point is, throughout, some lawyers and virtually all journalists have spoken of the ‘courage’ of the victims and their families.

And now, for the first time, we really are seeing courage.

Zach was also courageous in court — he was honest about not having been abused but not knowing if the affection was grooming — John Ziegler mentions Zach is a careful and fair religious person.

Now, two have come from a confusing place with a deep courage and this is so admirable.

Unlike what I think about Fina, I still think McGettigan during the trial days, before selling out, was careful and ethical, and also Ben Andreozzi was. But both know Sandusky is innocent and should have stood up and said something, not kept quiet and accepted the money on the basis that the system is so screwed.

None of us is perfect. Obviously the main culprit against Sandusky was failure of jury secondment when Shubin said his own adopted son accused him, and the fact Eshbach’s wording of the presentment quoted the words ‘oral sex’ in a way that lawyers, but not journalists, would understand had been quoted out of context and had not occurred. Journalists misunderstood that the grand jury presentment was not the type of legal document that allows them to state facts as if they have been proven. The heading of the presentment — what did she title it — something like ‘statement of facts’ — confused journalists.

Eshbach knowingly falsified the Presentment as to what McQ witnessed and within three days, the PSU Board pled guilty on behalf of all parties. She knew GJ 1 couldn’t indict and they closed without a finding because McQ and Dranov (who didn’t appear at GJ1) testimony was exculpatory. Shes a disgrace and the Board played it like a bad Tylenol case except they destroyed innocent mens lives. Hoping that the truth is allowed to surface through these diligent efforts.
