Raniere’s Rule 33 Motion Expected to Accuse FBI Agents of ‘Creating’ Evidence Regarding Child Porn Pics of Camila

The canary in the coal mine is an indicator of a problem there. If it lives, there is no problem. If the canary dies, there is a problem. So it is with this rule 33 motion in reverse.

According to multiple sources, previous reports, and earlier court filings, Keith Raniere’s defense team is expected to file a motion arguing they have evidence that the 30 plus nude pictures that were shown to the jury of Camila, when she was purportedly 15, during his 2019 criminal trial, were tampered with by the FBI.

If it is true that the FBI tampered with or created evidence in order to convict Raniere, this will not necessarily negate Camila’s civil claims.

It is, of course, possible that two things may be true: that Raniere did actually take photos of Camila and sexually abuse and rape her when she was 15  –  and that the photos of Camila used at the criminal trial by the prosecution were not those photos.

They may have been photos of Camila when she was older. More specific to the allegation of tampering is that the photos, whether she was 15 or older, were not found on the hard drive when it was seized by the FBI pursuant to a search warrant but were manually placed there later by FBI agents.

Much will be written about this in the coming days as evidence is released.  This evidence will almost certainly find its way into a public court filing and most likely will appear in the form of a Rule 33 motion, a federal motion filed after a conviction when new evidence of innocence or prosecutorial misconduct is discovered.

Raniere’s original appellate attorney, Jennifer Bonjean, wrote in her appeal that a Rule 33 motion will be forthcoming.

A Rule 33 motion either seeks to have a conviction vacated and a new trial held – and it is adjudicated by the same judge that presided at the trial.

Should it be determined that the FBI did tamper with the photos of Camila, it will be a massive news story – and create serious legal issues for the FBI agents who participated in this conduct. It might also result in Raniere getting a new trial, since Camila and the evidence of her underage photos not only caused Allison Mack to admit to crimes and take a plea deal, it also caused all the other NXIVM defendants, other than Raniere, to plead guilty within a few days of the discovery of the Camila photos, which were supposedly only found months after the hard drive was seized and just a month before trial.

Frank Report is taking no editorial position on the veracity of the allegations of tampering.

They may be true or they may be an utter fabrication by a convicted felon who may otherwise have to serve the rest of his life in prison. Raniere, who will turn 61 on August 26th, was sentenced to 120 years in federal prison plus 5-years of supervised release after that.

Frank Report, however, does take the position that these allegations should not be buried or dismissed on a technicality. The allegations are of such a serious nature that if they are backed by any shred of reasonable evidence, they should be thoroughly investigated and either dismissed as nonsense and frivolous or shown to be valid.

If there is a preponderance of evidence showing that evidence was tampered with or fabricated, then appropriate criminal charges should be filed against everyone who participated in this atrocity. Clearly, if it is true, the crime of tampering or planting evidence by government agents is far worse than anything Raniere was convicted of doing – and letting the guilty parties go unpunished is a threat to everyone’s liberty.

The Rule 33 motion will not likely be filed under seal for the court has a policy of not shielding the names of the accused.

The public has a decided interest in hearing about this matter.

If Raniere presents anything close to what would be normally viewed [if it was not coming from Raniere] as evidence, a special prosecutor could be appointed since otherwise the alleged crimes fall under the jurisdiction of the very agency that will be alleged to have committed them– and foxes never do well investigating evidence at the henhouse.

If the allegations of evidence tampering and evidence creation are untrue, as I imagine most readers will assume, then these false efforts must be exposed as false attacks by a desperate and reckless convicted felon who is willing to besmirch the good names of the agents who prosecuted him.

Either way, the Department of Justice should welcome this investigation for they are always assuring the public that they are above suspicion and the custodians of the highest level of integrity and trust in our land [as the watchdog of the liberty of targeted defendants] and that whenever they accuse someone of committing crimes, they do it fairly, impartially, and are always interested in justice above all and never winning convictions for their own sake.

We should trust that they have done so not for the purpose of conviction but for justice and public safety.

If any of this claim is true – even in the slightest degree with even a single agent – the DOJ, above all, should want to know. And if they are as honest as they assure us, then an investigation will surely prove it.

 

Was evidence planted on a hard drive to convict Keith Raniere? Frank Report takes no position on this matter other than to insist that all relevant evidence be carefully examined. If it is false, then it should be as easy to prove as it was easy to prove Raniere was guilty at trial. But if it is true – that FBI agents added pictures or changed dates to convict Raniere – then we have a problem much greater than Raniere. Even if the agents “knew” he was guilty of raping Camila but just could not prove it, this cannot justify planting evidence. Planting evidence on a guilty man will inevitably lead to planting evidence on an innocent one. Like in all matters, we should presume the innocence of the accused,

  • These allegations should be met with a good deal of skepticism. Yes, police misconduct is possible. But a laptop is exactly the place where you would expect to find these photos – and you would not expect to find them anywhere else.

    Supposedly, then, the FBI found these pictures in a place that had nothing to do with Raniere, but then put them on his laptop to make it seem like they were his photos? Does’t this seem very, very unlikely in light of Camilla’s testimony? That a different person was taking naked pictures of the 13 year old girl that Raniere was molesting, and the photos show her in the exact place where Raniere did the molesting, and the FBI luckily found those photos just in time to plant them on Raniere?

    What an incredibly convenient thing.

    I guess anything is possible, but this sure sounds like another ginned-up conspiracy theory.

Karen and Keith, regardless of their accomplishment of RPI, however low for Keith, were going nowhere after graduation and were not willing to pursue academia. They aspired to a life of ease but lacked the social skills and connections. Ever the pretentious underdogs, they took some time off to stay in the area, looking for some action…

    I imagine that many are unfamiliar with Halfmoon in the early 80s and Saratoga. If you are, it is easy to see how RPI grifters (Keith and Karen) could look for wealth without pursuing a graduate degree, with minimal prospects at hand, and glom onto an aimless child of wealth like Pam Cafritz during ski season. Like the Bronfmans, Pam was a somewhat uneducated product of Washington, DC socialites. And let it be said, at that particular time, with Saratoga “in decline”, it was an easy mark.

    Karen is quite the smooth operator. Ultimate Confidente extraordinaire. Keith did compartmentalize, but not without help. It must have been humiliating to be relegated to the Old Lady Gang, watching her compatriots die. Has she not alledged that perhaps she was poisoned? She is so very careful and always has been.

    And yet, she does not speak in Nan’s, or anyone’s, defense. These community members that she mentored and loved. It is so strange that her name does not come up more often.

    • Short answer: The FBI was paying an informant, not bankrolling publishing. Also, this allegation is merely a claim made by the lawyers defending a neo-Nazi, in an attempt to suppress evidence prejudicial to their lovely client.

      The case is actually kind of interesting, prosecuting the head of something called the Atomwaffen Division. It is, of course, a “Division” only in the imaginary sense, composed not of thousands of crack heavily-armed troops goose-stepping across the landscape, but of a dozen or so sad lonely crackpots indulging their violent fantasies.

      The books in question are fictional, according to the Vice article. Standard post-apocalypse stuff, but with a white supremacist twist. Ridiculous trash that might be good for a laugh.

  • It will be interesting to see what evidence Keith’s team presents. They do have to prove it occurred, not just theorize it. Proving such a thing is hard to do under the best of circumstances. Proving it while admitting Keith had some photos but just not those specific illegal ones…that will be a neat trick to see them pull off.

    If successful, yes it would lead to a mistrial considering those were critical charges and it be difficult for the prosecution to say the Camilla charges and testimony didn’t influence the results of the other charges. It may not necessarily vacate all the charges but generally, the idea would be to err on side of “goddamn fools” and just start over.

  • I seem to recall Cami had some kind of surgery after her 15th birthday and the photos do not show her scar. Which proves she was at least 15 years old. Now how would prosecuters get their hands on 30 naked pictures of her at that age at all? And plant them on his computer as well? Very highly unlikely. Good luck with that.

  • I’m not sure why a lawyer would bring up a Rule 33 motion if there were not some truth in it. It is a risky career move for a lawyer and for a defendant alike. Loss of reputation after losing a motion like this could be devastating.

    Regardless of when the photos showed up, if there is to be a second trial, Cami is now here to tell the truth of what happened with Raniere’s twisted sexual behavior towards her.

    We know he likes his women young. If not young, they at least have to look young. He likes to entrap them into enslavement to “only him” for the rest of their lives. Without children and into a loveless relationship, ready for his call, for his pleasure.

    The Raniere boat left the harbor and he will spend the rest of his unnatural life behind bars regardless of what happens with his Rule 33 motion.

    • I do think tampering with evidence is similar to what keith did or worse because tampering evidence can lead innocent people to lose their freedom and be locked in a cage forever just to enhance the career of some lawyers in the justice department.     It’s ridiculous to compare a potential witness tampering to what Keith has done. It’s not something you can or should compare. Those are two entirely different things, and, granted, both are very, very serious.

  • IF Keith gets a new trial (highly unlikely), then Cami will testify under oath.

    This will result in a further waste of Clare’s money, as well as the court’s and a new jury’s time.

    More trauma for Keith’s victims.

    And Keith will still be in prison.

    Convicted again. Except now he will be officially labeled a rapist and child sexual predator by a court of law.

        The idea that Keith would get off on seeing all these women he abused again instead of just rotting with the other pervs in prison during a second trial is distasteful as well.

    This allegation of tampering reeks of desperation. There is no evidence supporting it, and the allegation has been thoroughly presented here already by the Nxivm dead-enders. It’s based on “analysis” allegedly done by two paid consultants, paid by Raniere’s Scooby-Doo investigator gang, neither of whom could have had access to the drive and one of whom lives and works in India.

    Sure, any credible evidence of FBI malfeasance should be investigated. Credible evidence, this ain’t.

    These are naked pictures of underage Camilla, found on Raniere’s computer. This issue came up at trial, the transcript of which will be reviewed by the appeals court.

    That Raniere’s appeals lawyers are desperately tossing everything but the kitchen sink into their appeal shows how insubstantial is the basis of their appeal. Raniere is guilty as hell and even they know it. They’re wasting the court’s time, but then lawyers are often paid to waste time. The judge(s) who have to wade through all this crap though may not be amused. Not with a COVID backlog of cases to get through, some of which may have merit.

    Raniere is going to remain in prison for the rest of his life.

      However, it must be noted that if the allegations of evidence tampering and evidence creation are untrue, then the blame should land SOLELY on the CONVICTED FELON, and not on anyone who was rooting for due process.
