Pensacola, Florida — The federal lawsuit brought by New York attorneys Allan Kassenoff and Constantine Gus Dimopoulos against Robert “Robbie” Harvey, a social media influencer with 3.1 million TikTok followers, may turn on whether it is an illegal SLAPP suit.
Filed in the United States District Court for the Northern District of Florida, Kassenoff and Dimopoulus’s lawsuit claims Harvey’s TikTok videos are grounds for defamation, intentional infliction of emotional distress, tortious interference with a business relationship, cyberstalking, and harassment.
They seek $150 million in damages.
Harvey’s attorney, Jonathan Davidoff, plans to mount an anti-SLAPP (Strategic Lawsuits Against Public Participation) defense, arguing the lawsuit is a meritless or frivolous legal action to suppress freedom of speech.
Harvey’s videos about Kassenoff and Dimopoulus have amassed around 39 million views on TikTok, where he provides reporting and opinion on Kassenoff’s divorce and custody case and the death of his wife by suicide.
Calling the lawsuit “a spiteful revenge lawsuit,” Davidoff said Kassenoff and Dimopoulos are “attempting to reshape the narrative” about their roles in “Catherine Kassenoff’s torturous plight throughout her divorce from Mr. Kassenoff.”
Kassenoff contends Harvey’s reporting led to the loss of his position at Greenberg Traurig, where he reportedly earned $1 million per year as a patent infringement litigator. Kassenoff alleges Harvey’s “reckless and false” videos incited his followers to contact his law firm and one of its prominent clients, Samsung, forcing his ouster.
Dimopoulos, who represented Kassenoff in his divorce and custody case, claims Harvey encouraged his followers to “bombard” his office with phone calls and emails, disrupting his legal practice. Dimopoulos claims he received over 2,700 harassing calls in a single day.
The focus of the lawsuit is on the truth of Harvey’s reporting about Kassenoff’s late wife, Catherine.
On May 27, Catherine Kassenoff, also an attorney, posted “My Story” on Facebook.
In her “My Story” post, the last of hundreds of posts on her divorce and custody action, Catherine revealed she planned to end her life through assisted suicide at an unnamed Swiss clinic later that day.
She blamed her husband and his attorney, Dimopoulus, the corrupt family court system they manipulated, and a new cancer diagnosis for her planned suicide.
She wrote, “I can no longer endure the abuse and terror of Allan Kassenoff, who has spent the last 4 years mercilessly trying to incarcerate me on false charges. Perhaps if I had the physical endurance to keep going, I would. But with a new, terminal health issue that will soon be severely limiting my physical strength as well, and with no protection from our courts, I cannot keep running from Allan. I was recently diagnosed with a virulent and life-ending cancer.”
Catherine created a publicly accessible Google Drive to share documents, pictures, recordings, and videos for the media and the public.
In a surprising claim in the lawsuit, Allan Kassenoff alleges Harvey and Catherine conspired to lie about Catherine’s cancer diagnosis before she died.
The lawsuit claims, “Upon information and belief, Ms. Kassenoff and Defendant Harvey concocted the lie that Ms. Kassenoff had been recently diagnosed with terminal cancer in order to make Ms. Kassenoff’s ‘story’ more appealing and sympathetic to the public.”
Four days after Catherine’s final post on Facebook and three days after the Frank Report broke the story, Harvey posted his first of f 25 TikTok videos on the Kassenoffs.
Harvey’s TikTok videos prominently featured clips of Allan – which were videos Catherine filmed on her phone of her husband, and which she posted on her public Google Drive – that show Allan in an unflattering light – sometimes screaming uncontrollably, telling Catherine he hates her, and in one video teaching his children to sing about their mother being a “dead duck.”
Davidoff denies his client and Catherine conspired or that Harvey even knew of her before she took her life.
“Mr. Harvey was made aware of Ms. Kassenoff’s matter by his followers and then opined and reported on it as a member of the press,” Davidoff said.
If Harvey prevails in his anti-SLAPP defense, the judge will dismiss the case and may order the plaintiffs to pay the defendant’s legal fees and punitive damages.
If not, the case will start on the long road to trial, with discovery providing details, and a spotlight on a contentious divorce and custody case that saw a mother lose her parental rights, and ultimately her life, and the role of her husband and his attorney in the matter minutely dissected.
It will explore whether a TikTok star told the truth about them, and help define the line between First Amendment-protected opinion and the protection of truth as a requirement of the reporting of facts.

Fairness. I can send you over 100 pages of documents that show you what fair looks like in Connecticut. GALs placed on cases with significant conflict of interest. Pushing reunification therapy with out court orders. Engaging in therapy sessions. Getting locked out of the court room. Locked out of family relations. Using fear and intimidation. Psychologist abandonment than forcing re engagement. Failure to report third party payer. Withholding legal funds appropriated for the minor not the defendent. Misusing the funds to place the mother in an economic disadvantage. With holding information from the court. No notification of termination of GaL services when orders where extended through covid. Defending using house hold funds during divorce proceeding. 2 Child support financial affidavit doesn’t match mortgage application. Both signed off on by defendants legal counsel. All attorneys also provided with documents.. this is only pieces of what happened. I would be hard pressed to not know something is going on in family court. The attorney general office, department of public health and the bar association already has all my information. Just in case anyone disbelieves. Blowing the whistle is frawned upon in Connecticut and nothing is done about it.

Davidoff might end up as a witness, yes, but there is no reason he can’t represent Harvey right now, and certainly not at the beginning of the case at the pre discovery phase. Given his history with Gus, he might actually care that Harvey is being attacked for trying to shine a light on the dirty tactics used by Gus and others in what many of us know is a corrupt Family Court system. I’m not a lawyer, but this doesn’t sound right. Anti-SLAPP are state statutes not federal statutes. It’s extremely limited on the federal level. Allan filed this lawsuit in federal court. I don’t think this defense is right.

Catherine appears well put together to me. She has intelligent legal arguments. It’s a dead giveaway that Allen continues to insist on Catherine not being able to provide a roof over the children head. She doesn’t appear to have an unspecified mental health issue. She appears to have a series of stressors brought upon her. Silenced and discredited because of the greed. Our nations courts are not working. They are currupt to the core. She was physically, emotionally and spiritually exhausted. She is dead. Allen also used platform in social media to provide his own editorial of the case. Engaging in deflimation of character of his former spouse. Because more people were believing Harvey’s report on Allen’s actions he and his attorney have decided to have a legal temper tantrum. There is no one to bring a lawsuit against him for using questionable evaluators to engage in deflimation of character of Catherine in family court. A license to practice psychology court vendor spreading disputable facts is leading the courts into dangerous territory. Relentlessly. Shut the AFCC down. Clean up our nation legal system.

At one point Robbie turned this personal saying how he doesn’t like this guy etc … Allan is a litigating attorney he knows not to swing accusations w/out facts to back them ! Wasn’t it Robbie Harvey who said “he welcomes a lawsuit!”?

I think they filed under diversity jurisdiction, meaning as controversy over $75,000 with defendants from different states. If that’s the case, the state law anti-SLAPP protections under Florida law are available.

It is correct. He filed in federal court based on diversity, but state anti SLAPP is applied. There is a long history of this in various courts as many defamation claims are filed in federal court against publishers based on diversity.
So Harvey is represented by Davidoff who has claimed that the same court didn’t do justice in his divorce….
Interesting little circuit of individuals who couldn’t prove their claims in their own divorces all hooking up to support each other. Doesn’t this cast doubt on the narrative that women aren’t being treated fairly in the courts? Isn’t this just evidence that a small group of litigants are simply unhappy they couldn’t prove their claims and then band together to support each other to allege this is a pervasive issue when it is not? Why would Harvey retain Davidoff but to continue a false narrative that the courts are a problem when it seems that a troubled group of unsuccessful litigants are looking to shift the blame off their own responsibility in divorce outcomes?

There’s a big difference between Freedom of speech and actively having your 3M followers go after someone’s job and harass their employers and clients in an attempt to get him fired (successfully). Which would likely be one of many reasons this suit will not get dismissed. Robbie is on camera relishing and taking credit for Allan getting fired. Having his followers harass Allan, Gus and others involved is not free speech.
It does not go unnoticed that Jonathon Davidoff, who we all know is a friend of Catherine’s is representing him. Davidoff himself has sued Gus 2 times bc Gus represented his ex in their divorce. He has also been on record as Catherine’s attorney in the divorce. I’m not familiar with the law but he may be asked to recuse himself for various conflicts.
The only slap should be across the face for these 2 clowns to team up.
