Clare Bronfman Deserves A Longer Sentence Than Everyone Except Raniere

In a little less than three months, Clare Bronfman will be sentenced by U.S. District Court Judge Nicholas G. Garaufis in conjunction with her having pleaded guilty to conspiracy to conceal and harbor an illegal immigrant for financial gain – and to fraudulently using another’s identity.

Judge Garaufis will be the sole arbiter of how much time Clare Bronfman spends in federal prison.

At the time she pleaded guilty to those two crimes, Bronfman was facing several much more serious charges.

Per the second superseding indictment in her case, Clare had been charged with the following crimes: Racketeering, Racketeering Conspiracy, and Conspiracy To Commit Identity Theft.

Had she been convicted on all those charges, Clare could have been facing as much as 45 years in prison: 20 years each for the Racketeering and Racketeering Conspiracy charges – and an additional 5 years for the Identity Theft charge.

But even if she were convicted on all of those charges, it is quite probable that, per the applicable Federal Sentencing Guidelines, her prison sentence would have been in the 33-41 month range.

So How Did Clare Come To Plead Guilty to Two Different Crimes?

Frank Report readers may wonder how it is that Bronfman ended up pleading guilty to two crimes that she had not previously been charged with.

It’s a little confusing but let me try to explain…

When federal prosecutors want to make a plea deal, they have all sorts of options.

Usually, the deal is pretty straight forward: if the defendant agrees to plead guilty to one or more of the pending charges against them, the feds will drop the others charges(That’s exactly the structure of the plea deals that the feds struck with Allison Mack, Lauren Salzman, and Nancy Salzman).

Do the elephants on Clare Bronfman’s scarf imply that she has a long memory? I don’t think she was implying she was a Republican – since Judge Garaufis was a Democrat appointee. Maybe it was simply a fashion statement.

But in Bronfman’s case, the feds needed to be much more creative because they were much more interested in getting some of Clare’s money than ensuring that she spent an appropriate amount of time in prison for her NXIVM-related criminal activities.

So, here’s what they did.

First, they drew up a “superseding information” that consisted of the two charges to which Clare had agreed to plead guilty.

In this context, an “information” is a formal criminal charge that has not yet been presented to a grand jury. As such, it is usually used only when a defendant has agreed to plead guilty and has waived their Fifth Amendment right to be indicted by a grand jury.

So, in Clare’s case, a deal was worked out whereby she would agree to plead guilty to the two new charges in the “superseding information” – and the feds would agree to drop the pending charges against her.

Furthermore, per the terms of her plea deal, the feds have agreed that Clare’s offense level will be adjusted downward from 20 to 16 – which means that her prison sentence will be in the range of 21-27 months.

She will also be subject to a fine of $250,000 – and a special assessment of $100 – for each count. And she will also be subject to 3-years of probation following completion of her prison sentence.

Oh – and one other minor detail – Clare agreed to forfeit $6 million of her unearned/inherited money in lieu of having to forfeit any of her properties that were utilized in conjunction with NXIVM’s criminal activities.

So, aside from the little overview regarding criminal law, the lesson here is pretty clear: if you have enough money, you can buy the justice you want and avoid the justice you deserve.

How Much Time Will Clare Spend in Prison?

Let’s assume that Judge Garaufis sentences Clare to 27 months – which is the uppermost limit of her sentencing range (She can appeal any sentence over 27 months).

And let’s assume that Clare is a model prisoner – and doesn’t commit any serious violations while she’s incarcerated.

If those things hold true, then Clare will get about 4 months sliced off her sentence – which brings her down to 23 months.

In addition, Clare will also be eligible to serve a portion of her sentence under “home confinement” – which will be essentially the same as her current living arrangement.

She will likely get at least 6 months – and maybe as much as 12 months – of home confinement.

So, if she only gets 6 months, of home confinement, she will end up spending 17 months in federal prison.

And if she gets the full 12 months, that number will drop down to 11 months.

And if Judge Garaufis only sentences her to 21 months in prison, she could actually be incarcerated for less than 6 months.

How Much Time Should Clare Spend in Prison?

This is where things get really subjective.

Justice, like beauty, is in the eye of the beholder.

So, let me share with you what my eyes see in this case.

Clare Bronfman

First, many of the criminal activities of the NXIVM crime syndicate would never have occurred if Clare hadn’t financed them (Example: It was Clare who provided the money that was used to hire Canaprobe to obtain financial and other personal information about various federal judges and other perceived enemies of the cult).

Second, Clare was an active participant in – and actually oversaw – many of NXIVM’s criminal activities (It was Clare who hired people like Steve Ose and Ben Meyers to hack into the computers of NXIVM’s enemies – and it was Clare who flew to Toronto, along with Pam Nichols, to pick up what turned out to be falsified records).

Third, Clare perjured herself on several occasions in order to help advance NXIVM’s interests (Example: Clare lied to the grand jury that indicted Frank Parlato, lied to the New York State Police regarding the alleged hacking of NXIVM’s website, lies to the Vancouver Police about Sarah Edmondson and Mark Vicente, etc.).

Fourth, Clare personally benefited from some of NXIVM’s criminal activities (Does anyone think that Sylvie or any of Clare’s other NXIVM lovers found her attractive and desirable?).

Fifth, Clare enjoyed punishing people – and destroying their lives via NXIVM’s patent-pending “terrorism by litigation” methodology.

So, how much prison time should this pathetic excuse for a human being actaully serve?

In my opinion, 30 years – or one year less than Raniere’s sentence – whichever is greater.

Just like Raniere, this inhumane, soulless, conscienceless bitch deserves to die in prison.

What Will Likely Happen?

Unfortunately, our criminal justice is far from perfect.

So, rather than being imprisoned until she’s 70 years old, Clare Bronfman will likely be out of prison when she is 42 or 43.

And then, she will use her wealth and power to persecute the people that she blames for ruining her life – and that of her Master, Keith Raniere.

People like Frank Parlato, Catherine Oxenberg, Sarah Edmondson – and anyone who testified as a witness for the prosecution in Keith Raniere’s trial.

Frank Parlato defied the exalted one Keith Alan Raniere. The results were bad. Raniere was arrested and languishes in a prison cell while Parlato roams free.

That, unfortunately, is how I see this sad little tale turning out.

Unless, by some miracle, the new U.S. Attorney for the Northern District of New York actually brings appropriate criminal charges against Clare and the many others who aided and abetted Raniere and his codefendants in their massive criminality.

I don’t think that’s very likely – but, then again, I also buy Powerball tickets on occasion.

Maybe it’s not realistic to look forward to more charges on the way for Bronfman or her sister or Raniere, along with several other Nxivm/DOS people. But I think that especially New York’s Northen district has got the goods to do it already. If anything, this interim period could be a pause while waiting for Judge Garaufis to deliver sentencing for the current convictions.

With the money power and name clout behind the Bronfmans, seeing justice subverted on their behalf is typical. Nobody, even at a casual glance, could be oblivious to money’s impact.

Back when I was a teenager, I remember my dad putting his head down and almost crying about just such an injustice from the 1960s. A very wealthy young American woman had murdered her South American lover, with dreadful brutality, up in the eastern United States. She then removed his testicles and sent them, packaged, to his family in South America. That is how his parents and siblings, etc., found out that he was no longer alive.

The wealthy murderess never had to pay for her crime, even after admitting what she’d done. She went to a vacation spa hospital for a very brief amount of time, as things were being worked out and negotiated in her favor. That was the end of the affair.

In fact, the murder, really so very grim and sensational, received barely a blip of publicity at all.

I’ve always thought that the prosecutors’ idea was probably to make Bronfman pay for the costs of prosecution. I believe that a case like this, starting with the investigations and grand jury, could indeed have cost the taxpayers several million dollars.

Given that Bronfman’s principle culpability lay around funding NXIVM and Raniere, that’s fitting in a way.

But on the other hand, I have to agree with Claviger that when it comes to the general conspiracy, she’s the next most guilty after Raniere. She just wasn’t as involved directly in perpetration of the worst abuses as others were.

I think this shows the general bias of the legal system towards treating “white collar” type crimes much more lightly, even when they ultimately result in much of the same impacts on victims as physical or violent crime.

What Clare & Sara Bronfman & NXIVM are costing tax payers is far more than the cost of prosecuting Raniere and a few of these NX clowns.

They engage law enforcement and other public agencies —often through corrupt, politically connected attorneys and PI agencies such as Dennis Burke’s AZ mafia spook retirement farm, Frontier — to spy on, hack, set-up, frivolously accuse, indict, extort, recruit and otherwise influence — obtain citizenship, etc. — at the monetary expense of tax payers.

Not to mention the toll on the public trust and the high cost of cover-ups to attempt to uphold that.

How many times has Clare run to some law enforcement, DA, AG or Gov. office herself, making false accusations, crying poor heire$$ victim?

Joe O’Hara was falsely indicted by DA and AG offices under the influence of NXIVM TWICE in the NDNY.

Alejandro Betancourt pulled a similar Clare-style wolf-cry in Mexico.

Fine that Clare’s $6M plea might cover the EDNY prosecution costs for now but how much is this new lawsuit she’s backing Raniere on against the Southern District Feds gonna run us?

The fact that Clare has the impunity and lack of remorse to back this lawsuit and carry on with other NX antics even while awaiting sentencing is telling.

To begin with, Raniere himself was a “parasite” as he liked to accuse others of being, living off of and wasting his followers’ wealth and resources, as well as imposing heaving costs on society – while evading taxes.

You are right that the Bronfmans have then subject the legal system, and society, to all sorts of costs.

Both, together, imposed some terrible costs on a number of individuals they persecuted.

And NXIVM, as an extreme cult, has been very costly for its members, people related to them also impacted, and once again society in general. There are women who will forever bear brands, relationships disrupted or ruined, lives and careers and personal finances derailed, and so on.

Back in 2001 the US DOJ brought in a new US Attorney named Patrick Fitzgerald to head the ND Illinois in Chicago.
Patrick Fitzgerald came from New York City and had handled a number of terrorism cases for the Justice Department.
The reason the DOJ brought in an out of state US Attorney was because he had absolutely no ties to the local power structure in either political party.

The local politician who approves this unusual step was Senator Peter Fitzgerald, no relation to Patrick Fitzgerald, who was a political maverick.
For his effrontery to the local political establishment Peter Fitzgerald lost his Senate seat in 2004 because Republican Karl Rove cut off all funding for his reelection campaign.
That’s how Barack Obama became US Senator.

However, over the next eleven years Patrick Fitzgerald managed numerous cases attacking corrupt local politicians from both political parties.
Both the Republican Governor George Ryan and the Democratic Governor Rod Blagojevich were sent to prison.
And Fitzgerald managed the Family Secrets case where numerous mob murders from as long ago as the seventies were solved.

One can only hope that the NDNY gets a US Attorney of the caliber of Patrick Fitzgerald.

This terrorism by litigation sounds scary. I agree she deserves one year less than Raniere. She acts like she was raised in a 3rd world country. I’m sure she’ll be properly milked one way or another of her blood money. I’ll be surprised if she spends one night in jail. Her money will buy her freedom. It’s become the American way. It wouldn’t surprise me if Clare is plotting her revenge on Frank and Co. Unfortunately death is the only thing to cure these conscienceless demons. Thank you Claviger for breaking down all the legal jargon in your articles. So many people are suffering from lack of knowledge. Is Albany really not going to charge this criminally insane group?

Lots of people in NXIVM engaged in Terrorism by Litigation.
Some of them later became the targets of this type of terrorism themselves.
Certainly Nancy Salzman should be considered a terrorist who bullied and intimidated people.
And anyone who blackmailed or coerced sex slaves with salacious materials is a kind of terrorist.

(All of the defendants in NXIVM are unappealing characters to some degree.)

Clare has a half brother Edgar Bronfman, Junior.
Edgar Junior is the Pater familias of the Bronfman family.
Uncle Charles, Edgar Senior’s brother is too old to be in charge of the family fortune.

Edgar Junior has a son named Ben Bronfman.
As you will see from the video below Ben Bronfman is half black.
Ben was born in 1982 and is only a few years younger than his aunts Clare and Sara.
Ben has inherited all of the musical talent of the family.
He was a member of the music group “The Exit” and he still performs and composes music.
Ben was married for a time to the Sri Lankan singer MIA
Ben and MIA met in the Brooklyn neighborhood of Bedford-Stuyvesant, the exact neighborhood where our good friend Nicki Clyne and her
sister-wife Michelle are shacking up.
Ben is also an environmentalist fighting non-existent Global Warming with an investment in a company that produces algae for fuel.

Liberty Science Center put him on the Board of Trustees because he is worth about 100 million dollars.

If you think that was bad here is Ben Bronfman in a white suit as a back up singer who does not sing and only dances around and claps his hands while the main man sings.

One would expect that being raised in an environment that enabled high quality, genuine education, would not lead to any association of with dressed up apes! (of any skin color)
