How Long Will Allison Mack Go to Prison?

Sometime in the very near future, U.S. District Court Judge Nicholas G. Garaufis is going to issue an order that sets the sentencing date for Allison Mack.

He’s already done that for Clare Bronfman (January 8th), Keith Raniere (January 17th), and Kathy Russell (January 29th) – and will soon be doing the same for Nancy and Lauren Salzman (My guess is that he’ll schedule the mother-and-daughter criminal team to be sentenced on the same day).

So, it seems like an appropriate time to review the process which the judge will follow in determining Allison’s sentence – and explain what will actually happen on the day she gets sentenced.

Allison Mack’s Crimes – And Her Plea Deal

As set forth in the Second Superseding Indictment in the case, Allison was charged with the following crimes:
– Racketeering
– Racketeering Conspiracy
– Forced Labor Conspiracy
– Wire Fraud Conspiracy
– Sex Trafficking Conspiracy
– Sex Trafficking (RE: Jane Doe #5)
– Attempted Sex Trafficking (RE: Jane Doe #8)

Rather than take her chances and go trial on those seven charges, the 36-year-old Mack opted to accept a plea deal.

During the course of her Plea Hearing on April 8, 2019, Allison made a number of admissions and statements. These included the following:
– She graduated from Los Alamitos High School (That puts her well ahead of her co-defendant, Clare Bronfman, who only finished 10th grade).

– She had one beer the night before her Plea Hearing – which sound a lot less elitist than the “one glass of wine” that Nancy Salzman and Lauren Salzman each said they had before their Plea Hearings.

– She committed Racketeering Act 10 – which involved state law extortion by collecting collateral from Jane Doe #5 and Jane Doe #8.

– She committed Racketeering Act 13 – which involved her accepting uncompensated labor and services from Jane Doe #5 and Jane Doe #8 who were afraid she would release their collateral if they did not provide free labor and services.

– She committed multiple acts of wire fraud by forcing lower-ranking members of DOS to turn over money, property and other things of value to her as collateral

During that same hearing, Judge Garaufis explained to her the applicable statutory penalties that would be applicable if she pleaded guilty to racketeering and Racketeering Conspiracy.

Those penalties are as follows:
– A maximum prison term of 20-years for each count;
– A maximum supervised release (AKA “probation”) term of 3-years for each count;
– A maximum fine of $250,000 or twice the gross profits or proceeds of the NXIVM enterprise;
– Restitution in the full amount of each victim’s losses as determined by the court;
– A $100 special assessment for each count; and
– Whatever criminal forfeiture was specified in her plea agreement.

During the course of her allocution, Allison said that she was “…prepared to take responsibility for acts in which I was involved, some of which I now realize were wrong”.

She also said that during her time with NXIVM, she “…became close with many individuals, many of whom are wonderful people, and some of whom I now realize are not”.

She went on to say that she now realized that she and others had engaged in criminal conduct – and that the goal of NXIVM was “…to further and promote the objectives of Keith Raniere”.

She also admitted that “At Raniere’s direction, I and other women sought to recruit other women to join DOS” – and that she knowingly took and withheld collateral from Jane Doe #5 and Jane Doe #9.

She stated that she had “…concealed Keith’s role as the head of DOS and characterized DOS as a women’s only organization, knowing that Keith Raniere was the head of the organization”.

She finished up with an impassioned apology.

“Uh, oh…Looks like I’m going to be heading off to federal prison soon”.

“I am very sorry for the victims of this case. I am also very sorry for the harm that I caused to my family. They are good people who I have hurt through my misguided adherence to Keith Raniere’s teachings. I apologize to them from the bottom of my heart, and I am truly very sorry for what I have done. Through this plea and the help of others, I have begun the process of healing and repairing the relationships in my life”.

How Does Allison Mack’s Plea Deal Compare To Lauren Salzman’s Deal?

Even though Lauren Salzman pleaded guilty to the same two criminal counts, her deal appears to be quite different than Allison’s deal (Unlike Allison’s plea deal, there are several sections in Lauren’s deal that are redacted).

Lauren Salzman and Allison Mack give each other a friendly hug. It is not known if they ever did a threesome with Raniere. 

For one thing, it appears that Lauren’s deal required her to appear as a witness for the prosecution in Raniere’s case – which she did do.

For another, it appears that a sentencing range was likely specified in her deal.

In any event, Lauren made many of the same admissions that Allison did in terms of the criminal activities she engaged in while she was a member of NXIVM.

But her apology seemed to be much more heartfelt than Allison’s.

“Your Honor, in light of reviewing all the discovery and having many months to reflect, I came to the conclusion that the most moral and the most just course of action for me was to take full responsibility for my conduct and that is why I am pleading guilty today and I’m very sorry for my poor decision-making and decisions that result in the harm to others and not the just victims in this case but to hundreds of members of our community and their friends and families as well”.

Is Allison Mack a Victim, a Perpetrator or Both?

There has been much debate on the Frank Report as to whether Allison should be treated as a victim, a perpetrator or both.

But regardless of what anyone thinks, the terms of Allison’s plea deal make it clear that from a legal standpoint, she is a perpetrator.

It’s possible that the Probation Officer who prepares her “Pre-Sentencing Report” may take into account the fact that Allison suffered from sleep deprivation and caloric deprivation for much of the time that she was involved with NXIVM – and recommend a relatively short prison term.

Allison Mack will perhaps be better remembered for her work with Dr. Danielle Roberts than for her acting.

It’s also possible that her Probation Officer may take into account the testimony of those witnesses who described Allison as a harsh “Master” who enjoyed punishing her slaves and as the one who often took the close-up pictures of other women’s vaginas for Keith to look at – and recommend a harsh prison term.

The “Federal Sentencing Guidelines”

Crafting appropriate sentences has always a tricky exercise for judges.

That’s basically why Congress created the “Federal Sentencing Guidelines” that most judges abide by when they are sentencing defendants who have pleaded guilty or been found guilty by a jury.

The sentencing guidelines were designed to take into account both the seriousness of the offense – and the defendant’s criminal history.

The guidelines establish 43 levels of seriousness – and the more serious the crime, the higher the offense level.

Each crime is assigned a “base offense level” – which is the starting point for coming up with the applicable sentencing guideline in each criminal case.

But each crime also has various characteristics that can increase or decrease the base offense level (Example: If a fraud case involved a $500,000 loss, that case is going to have a higher base offense level than a similar case that involved a $5,000 loss).

There are also various “adjustments” that may come into play in a case. These include such things as the defendant’s “level of involvement” in the crime; whether the defendant obstructed justice or attempted to obstruct justice during the investigation that led to the criminal charges; the defendant’s acceptance of responsibility; and whether the defendant pleaded guilty.

Finally, the guidelines also take into consideration whether the defendant has any prior criminal record.

So, How Much Time Should Allison Spend in Prison?

Without having a copy of Allison’s “Pre-Sentence Report” to review, the best I can do is make a reasonably informed “guesstimate’ as to what her applicable sentencing guidelines will be.

The “base offense level” for Racketeering and Racketeering Conspiracy is 19.

If anything, I would think the type of criminal enterprise that NXIVM was – and Allison’s level of involvement in the enterprise – will likely increase her base offense level by one or two levels.

Thus, assuming that she has no prior criminal convictions – which, insofar as we know, is the case – Allison’s sentencing guidelines will probably be 33-41 months or 37-46 months.

So, based on all that, I would estimate that Allison will likely end up with a prison term of 42 months – which means that she will likely spend about 30 months in prison and another 6 months on home confinement (She could get an additional 6-months of home confinement is she’s a model prisoner – and convinces her Counselor that she deserves that type of consideration).

Allison Mack will not look like this when she gets out of federal prison. 

She will also be fined $250,000, lose the assets she has already agreed to forfeit, pay $200 in special assessment fees, and be on probation for 3 years after she finishes her period of home confinement.

Allison Mack should be in prison NOW and spend the rest of her life there. In addition to incarceration for life, she should also have a custom made chastity belt locked onto her to prevent any self stimulation or orgasms, which would punish her to the max. She deserves it and no doubt she handed down such cruel sentences of permanent orgasm denial to other women. She is a disgusting witch who should NEVER see the free side of a prison cell ever again. Can’t understand why Clare Bronfman did what she did. Heiress to the Seagrams Liquor company she must have been rich already. It must have been for the sex. Raniere the leader sounds like a Jim Jones type. If Allison did it for him and had sex with him she could have gotten a lot better. She married a woman but people think that was a scam. I wonder what Kristen Kreuk’s involvement was since she introduced her to them?

I fall in love in Allisons adorable smile, watching Smallville 15 years ago. It grows over the years, when I found out, that she was born, not far from me (Neumuenster->Preetz, Germany … around 20 miles apart) … very unlikely for an american actress. It really broke my heart, when I read, that she lost herself in this crazy cult, especially when she lured young women into her gurus harem (JNess).

I´m totally torn back and forth: For her crimes she deserves spending time in prison … but I really wish, that the jury will find her not gealty, because she was unfit to plead. I want to believe, that she was Raniers first and greatest victim and that she needs therapy.
I read, that his name is in the Guiness Book of Records, in the top 10 of the people with the hightest IQ. If it´s true, it´s really a small line between genius and madness. And then, it´s no wonder, that he can deceive young women, who are unstable and insecure. Allison said, she wanted to do something good, and I can´t tell otherwise: World Ethics Foundation, JNess – an organisation of feminists, who wants to help such insecure women. I just take a look behind the curtain 2018, when Allison did advertising on her homepage for the acting school “The Score”. The linked video was just bizarro … Allison sat across from Raniere, just smiling and nodding along, with an empty look in her eyes.

If her parents never left the northern state of Germany called Schleswig-Holstein to move back to the U.S., that would never happened to her. The worst cult we have, are Jehova´s Witnesses. If I have one wish, than, that Allison got free and will move back to her birth town, to go into therapy and to forget those crazy years. Here she can still act, and live a normal life … only a few comic nerds will recocgnize her. And Yes …. a part of me is still in love with her, and wants to meet her even once. (But no, if she did all this voluntary, I could never be in a relationship with her.)

PS: I search the internet for month now … verdict September, October, November … it´s not far from new years eve now … and still no verdict. Is this a good or a bad sign.

As a guy, i have to say your response is disgusting. Do you not understand what happened? Why this is wrong, or is objectification the only thing you do but not understand? I really enjoyed Allison Mack on Smallville, even having a celebrity crush. However she is still human, and subject to human laws and consequences. I am saddened this is the probability of her confinement. I believe it should probably be 2 or even 3x the guideline. I worry for any rehabilitation requirement or corrective behavior requirement to be lost and found unimportant. Alas, i am not a judge, nor have the credentials to be one. I trust our system only so far, and believe in this case, we failed our community and the victims affected by Mack and her actions.

There seems to be a light touch from the media and law when a woman commits an offence, but the whole world comes undone when a man commits the same offence. We don’t want to see Mack smiling in her photos, we want to see the mug shots, the same mug shots you’d give Lex Luthor if he had done the same thing.
These girls are criminals. They let their lusts and desires get out of control, and they began to act like pirates, nothing more. They weren’t threatened or brain washed into committing these crimes….nope, they were having fun. It’s fun to have people at your beckon call.
This case just shows us that slavery and sexual slavery are always a danger. This is why we have to put criminals who commit these acts in prison as a warning to anyone else who might be tempted to do the same.

I am going to guess 3 years or less.

The judge like most men including myself seems to have a soft spot for women. The judge ending the cross examination of Lauren Salzman is clear proof of his soft spot.

Does anyone believe the judge would have done the same thing for a man?

I believe there is little doubt that Ms. Mack falls under the heading of abuse victim who became an abuser. However, she is an adult and, as such, must be held accountable for her actions. I believe that her period of incarceration should include some form of psychological/psychiatric counseling as she is a damaged individual.
Those advocating that she take “the honorable way out” should be ashamed of themselves.

So, nope, Allison is not reclaimable. She doesn’t get it, never will. Her own words betray her.

Catherine Oxenberg can take her daughter to the next guru. India probably learned this tendency to follow a guru from her mother and grew up with it. It seems to me you don’t really have experience with the justice system. So many in the public believe sex offenders can’t change, can’t be rehabilitated, but the statistics just don’t show that at all. The vast majority can be treated, can learn the damage they’ve caused. Furthermore, the vast majority have mental health issues and are essentially sick, causing them to behave in ways that go outside the boundary of the law.

So yes, they are still responsible for what they do, but if they are given the help, the majority of them do learn, and do become better citizens, who DON’T re-offend.

I feel bad for anyone who thinks someone is a lost cause. Honestly, we don’t say that about a dog or a child, but you decide that for another human being. We all need help in some way, and God forbid someone would give up on you.

Thanks for the thorough explanation of the legal sentencing phase of the trial.
The first time Allison Mack appeared before Judge Garaufis he innocently asked her if he had bumped into her in the courthouse cafeteria before court hearings. I think he has a soft spot for Allison; And that coupled with the fact the judge halted cross examination of Lauren Salzman and put at risk the integrity of the trial which means he has a soft spot for women in general.

I think he gives Allison Mack a sentence at the lower end of guidelines.

I think she’ll get more than 3-4 years. Maybe a lot more. I wouldn’t be surprised if she gets 10. And Raniere gets life.

The above analysis seems to leave out the particularly cruel and bizarre nature of this case. The human branding. The kinky sexual angle. I think this had the judge well and truly pissed off. I suspect he’s the type of man who takes a hard line on this kind of thing. He seems a bit of a White Knight. He’s going to throw the book at Raniere. And probably Raniere’s loyal lieutenant Allison Mack as well.

He’s going to remember the testimony against her. Her eager enthusiasm for running DOS. Organizing the human branding that took place in her home. Her badgering of her slaves. The fact that she had slaves in the first place. That she saw no shame in this. He’s liable to remember the cruel nicknames she gave them. Telling one of them she “has a beautiful cunt”. As she took close-up photographs of it. To send to the slave-master Keith Raniere.

Yeah. This was no simple crime racket. It was a chamber of horrors, victimizing women. I suspect Judge Garaufis will have this in mind as he totes up the months and years this criminal is to serve. And he will not be kind to her.

But the things she did in real life I am NOT a fan of. Yes, I do understand that she was young & easily fooled, she was sleep deprived as well as starved. I take it you must come from one of the countries where the judges and the prosecutors work things out in advance and trials are just for show, but that’s not what happens here.

Mack did not need to know the real motive behind the conspiracy, to be fully culpable for her involvement in it. I remind you that considering home confinement as a part of the prison sentence is ENTIRELY AT THE JUDGE DISCRETION and since he pointed that for him it was just like being in Prison, i don’t see why he would ignore that.

You also have to consider that added to the many redeeming factors, she has fully cooperated.
Prosecution might not have called her at the bar but she was ready to do so, they just choosed her not to be allowed to defend publicly herself.
But the pre sentencing include her being able to explain her side of the story (with the investigation verifying that she says the truth).
Seeing what was said about her role (which is far from making her a leader.She is just a pawn victim who had to follow orders or else…)
I doubt the judge will aim at the highest level appliable.

Actually, no matter what people say or what her plea deal say (i remind that the criminal part isn’t written by the person who accept, it is likely a “placeholder” part given by the prosecution), she exclusively collected the collateral (and i repeat , Under coercion as it’s an extremely redeeming factor)

Allison was forced to sign the plea deal or accept to get a potential of life in jail (because Raniere’s background (pedophilia) would have dragged Allison in the same gutter…
Even thou she was NEVER connected at all to those crimes (especially since it happened before Allison was in the cult)

Sadly, she shouldn’t be involved in the trial at all as she was a victim of the cult. But due to the false information given by some (wrongfully claiming that Allison was the lead of DOS, that she created DOS, and the fact that the victim who testified was her victim) , she was considered a perpetrator.

No matter what is said, she is a victim, Nothing will change that!

Ok , know you got me, it’s an excellent excuse so my apology (and i’m sincere…he doesn’t deserve to be named at all if you ask me).

But i maintain the rest as you talk about “heinous act” and that is not what Allison did.
Allison said to be a “loving person” by the only victim who testified against her didn’t brand her, didn’t beat her, she just collected the collaterals just like many other victims.

Don’t fall for the “she was an henchwoman” , it’s BS and debunked in court.
And Don’t forget the fact that she was in a particular position.

The sleep deprivation is also proved…
And the impact is proved scientifically for both starvation and sleep deprivation.

If you ignore this, than the crimes wouldn’t exist because the supposed coercion that Allison exerced on Nicole is the reason she was a defendant…
She never threaten so technically it’s not even coercion at all
But the Monster (R not to name him) did threaten Allison and Nicole (Allison for the interview (atleast))

If you ignore the redeeming factor that prove that Allison is another victim, you are actually either doing a double standard (as Allison is not a victim while coerced but Nicole is while in the same situation) or you have to accept that no crime occured at all.

To put this plainly, “no matter what the facts, I will never change my mind.” An all too common method of argument. Back in the day of Smallville fandom, I learned about this kind of attitude all too well. It was, frankly, hilarious. Smallville began with no Lois character; it was Clark Kent and his high school friends, one of whom was Chloe, played by Allison Mack. Girl-next-door Chloe had a crush on hunky Clark, but in typical teen-tragic fashion Clark wanted to be “just friends”. I shed a tear just thinking about it. Well, Chloe (and Mack) had a fan base who were fiercely identifiable with poor forlorn Chloe, so imagine the furor when Lois was introduced a few seasons later. She can’t, can’t be the real Lois! Chloe is supposed to be Lois! The Mack fans were furious.

For years– literally years– the Mack fans insisted against all evidence that Lois wasn’t Lois, Chloe was Lois. They came up with convoluted, improbable theories of how it would be revealed that they spoke the truth. At conventions, they asked the writers and producers of the show, who told them politely that yes, in fact Lois is Lois and Chloe is not Lois.

It was really quite comical. But they were dead serious. The Chloe fanboys hated Lois. They hated the actress who played Lois. To the point of talking openly about slashing her face. Oh yes, they were serious.

Facts never change the mind of a true believer. This is why a few people still remain loyal to Raniere and Mack. Just as a few people remained loyal to Charles Manson.

This is why people join cults in the first place; some minds won’t be changed by facts. They believe what they want to believe.

Really!? Would you feel the same if these atrocities happened to you or your child? Just because your a “fan girl” to a make believe character you think she deserves a light sentence? Allison knows the difference between right and wrong. Victim or not she chose evil. Raniere did what masters do. He allowed Mack to become her true self.
