The Possibility of Another Superseding Indictment

Moira Penza makes the closing arguments for the prosecution.

For readers who question us about when the superseding indictment is coming – if it is coming – I think what Assistant US Attorney Moira Penza told Judge Nicholas Garaufis at a status conference on January 9, 2019, holds true today.

Penza told Judge Garaufis:

“The government continues to expect a superseding indictment in this case. Of course, we can’t promise a superseding indictment

“… There are a number of factors that are weighing into the timing considerations for a superseding indictment. Obviously, the government is cognizant of the trial date that is set as of now and we are moving expeditiously. One of the items that is in play is the privilege, the discussions regarding privilege as to a number of documents, a number of email communications that the government believes are relevant to our superseding indictment, and so one of the things that we are waiting for is resolution of a number of these privilege issues.

“In addition, there are always other complications with superseding indictments, but we do anticipate having one. We just can’t give the Court a precise date, but we do understand the benefit to the Court of having that type of certainty. We just can’t provide it at this time.”

I think the critical language here is:  “The government continues to expect a superseding indictment in this case….  we do anticipate having one.”

Sources tell me that the government is actively investigating this matter. Two new attorneys have been added to the prosecution team in recent monhs.

If the trial date is presently set for the end of April, I would predict that the superseding indictment will have to come sometime in March before the nitty gritty arrangements for trial get down to hard dates – and the release of material from the prosecution to the defense.

A superseding indictment almost certainly will result in the trial being pushed back until after the summer.

The government now says its expects their case to take at least 5 weeks to conduct – not counting the defense’s case. Judge Garaufis does not conduct trials in the summer.

I anticipate a trial in October.

You’ve been right on your predictions every time before, Frank. So I tend to believe your prediction. I’m just very interested to see WHO will be indicted. October sounds reasonable for the beginning of the trial. Does anyone know why some trials are public and others private? Like OJ’s for example. Is it up to the defense if they want it to be public? And obviously it really depends on how famous the defendants are for the media to even pick it up. I would love to make this trial my new reality show addiction lol

Kristin likely made her statement in regards to NXIVM due to a sensationalized article title that linked her to the “sex cult” because of her Smallville connection with Allison Mack that was constantly being tweeted for an entire day. This article also quoted Frank Parlato who only said that NXIVM used Kristin for recruiting purposes but didn’t tie her to the same allegations of wrongdoing that Allison was accused of. It’s been nearly a year later since that time and she likely posted this due to those events and also because she is a fan of John Green who is a writer and who is also a fan of hers. If my memory serves me correctly, there was a small twitter “conversation” between the two last year where she said she was a fan of his in a tweet relating to one of his books, and he responded with a tweet telling her likewise, i.e., that he was a fan of hers.

But that isn’t the way twitter works, Heidi. When you report a bot or an abusive account, you have to provide twitter with the account handle. There are probably several accounts using the name Scott Johnson, but they all have different handles.

Twitter doesn’t suspend unless they see abusive tweets from the account in question (and twitter usually just suspends the account for a day, in most cases) or if the reported account is an obvious bot or is impersonating someone.

You weren’t around when the comment section of this blog was best described as a “madman’s echo chamber.” When Schlock drove off all other commenters with insults and lies then proceeded to converse with only himself. Frank tried many interventions short of banning him and even now must spend precious time editing insulting, demeaning and untrue comments Schlock constantly submits.

Actually, it is a good thing that big companies start caring about the consequences of fake news and conspiracy theories. Deplatforming might be the only way to achieve this.

The big media companies should be hold responsible for the harm done by groups like anti-vaxxers for instance. Spreading false information causes real harm. Just think of stuff like pizzagate. Networks Kept ‘No Collusion’ Senate Investigation Result Off Evening Newscasts, Report Says

Major broadcast networks excluded from their evening news the results of the Senate Intelligence Committee investigation, which found no evidence of collusion between the Trump campaign and Russia.

Yet, in the past two years, the evening newscasts dedicated over 2,200 minutes, nearly fifth of their Trump-related reporting, to the Russia investigation, according to the nonprofit Media Research Center (MRC), which went through coverage on ABC’s “World News Tonight,” the CBS “Evening News,” and the NBC “Nightly News” between Jan. 21, 2017 and Feb. 10, 2019.

After interviewing more than 200 witnesses and reviewing 300,000 pages of documents, the Senate Intelligence Committee has found no evidence of collusion between the 2016 presidential campaign of Donald Trump and the Russian government, according to both Democratic and Republican sources on the committee.

But the networks not only shut the news out of the nighttime news, but, in case of the NBC and CBS, from their flagship morning shows as well.

“NBC’s failure to mention this on either Today or the Nightly News is especially egregious, since the story was broken by the network’s own Ken Dilanian on Feb. 12,” MRC stated in a Feb. 14 report.

“Over the past two years, broadcast evening news shows have spent more than 36 hours haranguing viewers about potential collusion between the Trump campaign and Russia. Given their keen interest in the subject, you might expect a bipartisan group of investigators finding ‘no material evidence’ of collusion to be newsworthy. But evidently, you’d be wrong.”

ABC’s “Good Morning America” dedicated less than one minute to the news on Feb. 13.

I have two simple questions Teddy,

1. Why can the people not wait for Mueller to finish his job?
2. Why do you ignore the results we already have, like for instance the people who did plead guilty?

Trump might or might not have been involved in collusion in person, but he has people around him, who were involved in shady deals with domestic or foreign power. So no matter what Mueller presents, he helped to drain the swamp. A swamp that was in part created by Trump. Some of the people he got into office are corrupt and Mueller’s investigation pointed it out. This is something we should not forget.

And to make it clear, the big media companies are not shouting “LOCK HIM UP” or are making up conspiracy theories. This investigation is based on facts. Mueller managed to deliver. I do not give a shit whether Trump will remain in office for 2 or 6 more years, but the connection to Russia and other foreign countries needs to be severed. For this to happen all the people who were actually involved need to be found and dealt with accordingly.

Let’s talk facts with the Mueller Investigation
The Crown Jewel in the coup was the appointment of special counsel Robert Muller to discover supposed 2016 Trump-Russian election collusion. Never has any special investigation been so ill-starred from its conception.

Mueller’s appointment was a result of his own friend James Comey’s bitter stunt of releasing secret, confidential and even classified memos of presidential conversations. Acting DOJ Attorney Rod Rosenstein appointed a former colleague Mueller—although as a veteran himself of the Clinton email scandal investigations and the FISA fraudulent writ requests, Rosenstein was far more conflicted than was the recused Attorney General Jeff Sessions.

Mueller then packed his investigative team with lots of Clinton donors and partisans, some of whom had legally represented Clinton subordinates and even the Clinton Foundation or voiced support for anti-Trump movements.

Mueller himself and Andrew Weissmann have had a long record of investigatory and prosecutorial

overreach that had on occasion resulted in government liability and court mandated federal restitution. In such polarized times, neither should have involved in such an investigation. Two subordinate FBI investigators were caught earlier on conducting an affair over their FBI-issued cell phones, and during the election cycle they slurred the object of their subsequent investigation, ridiculed Trump voters, and bragged that Trump would never be elected. Mueller later staggered, and then hid for weeks the reasons for, their respective firings.

The team soon discovered there was no Trump-Russian 2016 election collusion—and yet went ahead to leverage Trump campaign subordinates on process crimes in hopes of finding some culpability in Trump’s past 50-year business, legal, and tax records. The point was not to find who colluded with whom (if it had been, then Hillary Clinton would be now indicted for illegally hiring with campaign funds a foreign national to buy foreign fabrications to discredit her opponent), but to find the proper mechanism to destroy the presumed guilty Donald Trump.

The Mueller probe has now failed in that gambit of proving “collusion” as even progressive investigative reporters and some FBI investigators had predicted.
