The Metropolitan Detention Center [MDC] in Brooklyn is bad on its best day, but following a fire on January 27, things got worse, not only for Vanguard, but for all 1,600 prisoners caged there.
Attorney Marc Agnifilo, as part of his Third Motion for Bond, tells how Raniere is suffering:
- MDC has been without heat, electricity, hot water, commissary or warm food since January 27, 2019.
- MDC has not provided Raniere with means to keep warm.
- The temperature is 44 degrees.
- Corrections officers are wearing masks to avoid the smell of noxious fumes, but have not provided masks to inmates.
- Raniere can’t see his lawyers to prepare for trial.
According to witnesses and as reported in the New York Daily News and the New York Post:
- MDC has no electricity and is operating on a generator.
- There’s only heat in the afternoons.
- Reportedly, according to a prison guard, the temperatures have dipped as low as 33 degrees.
- Prison guards are wearing scarves, winter hats, and coats inside while they work.
- The darkness makes it dangerous for guards to move inmates.
- Prisoners have suffered in the cold for more than a week, nearly freezing in the dark.
- Many can’t sleep. Their throats are hurting.
- On the day following the fire, inmates got no lunch and only cold food for dinner. Some of the prisoners on restricted diets got only bread or went without food.
- Since then, food is served cold.
- Prisoners have tried to block vents in their cells with clothing and blankets to keep frigid air out.
- One prisoner claimed he had only been given the single, thin blanket received upon intake. He claimed he has not been provided additional blankets or clothing.
- Thermal shirts or pants and blankets are available from the commissary, but the commissary is not open.
It is not clear how soon conditions will be corrected.
Yet, is the one week or longer, of cold at MDC reason to release Raniere on bail, as Agnifilo suggests to Judge Garaufis?
If the judge were to release Raniere, wouldn’t every other inmate at MDC be entitled to similar treatment (I know there’s only Vanguard but I’m not sure the judge will see things that way)?
Can the government find a way to turn the heat and electricity back on, and serve warm food?
The judge can push for a speedy trial, but it seems that a superseding indictment is coming and will push the trial beyond the current April 29, 2019 start date. Raniere could spend most of 2019 at MDC awaiting trial.
There is, of course, another explanation for what’s going on at MDC. Did Raniere grow tired of his attorneys’ inability to get him released on bail – and simply take matters into his own hands…er, I mean his own mind? Did he, in fact, cause this power outage at MDC by using his once-patent-pending-but-later-rejected tech to cause the fire in an attempt to win his freedom? If this doesn’t work, will he wreak further havoc on MDC and force the government to free all the inmates?

Seems KAR’s unique problem was all this MDC catastrophe stymied his “due process rights” to IM and EM his attorneys near daily. (Lucky for Danielle Smith.)
I have an idea, why doesn’t Marc Agnifilo move in to MDC to ensure he can meet with his client whenever KAR’s in the mood?
That’ll not only protect KAR’s due process rights no matter what act of God or other lesser being threatens to interfere with those, but Marc can start working on Clare’s next lawsuit against MDC on Vanguard’s (maybe even soon her own) behalf.
I’m sure Clare’s $$$$$ are burning a new hole in her pocket since she’s not replenishing any other defense funds.
And it would be a huge benefit to her soon unrepresented co-defendants if they can get MDC in better shape for their upcoming stays!

to a better hypothermia article in the New York Times on hypothermia. Keith and the other inmates would already have been succumbing to hypothermia if it were so cold for such a long period of time. When you fall asleep you become incredible susceptible to hypothermia. One of the inmates would have all ready been hospitalized.

Mind over matter. Keith could imagine he is back in sunny Mexico, lounging by the pool his little Spandex (which miraculously appeared on the the floor outside his room). Failing that he could physically create heat by star jumping in the morning and enjoying the heaters being turned on in the afternoon.
In regards to the cold….
Allow me to point out the obvious. Inmates would have already started to succumb to Hypothermia!!! If it were really that cold.

I am outdoors person. Kieth and the other inmates would have been dropping like flies by now or at least be in the hospital.

I don’t think a true chart for ambient temperature and hypothermia exists. Just charts for frostbite or charts for hypothermia when submerged in water.

My biggest fear is that some way Raniere makes bail. Stranger things have happened in the American legal system. At first blush it sounds preposterous but similar events have happened.
I doubt the judge is going to single Raniere out of the 1,600 or so other inmates so that he can warm up his square feet.
I think many of us share your fears, niceguy — and to be painfully fair, it might well seem to some that KAR’s ass has been incarcerated in a very nasty place for a long-ass time for a yet-to-be-tried person. I like your, “c’mon, it ain’t all THAT bad,” scientifically provable strategy. But the problemo is we all who know a tinge, know KAR outta be in a MAXIMUM SECURITY Solitary confinement, Hannibal Lecter cage and outfit complete with the mask to avoid his escape or further endangerment to society – especially under age girls.
We don’t need to waste our tax dollars on a supermax prison for Raniere. He can’t judo his way out of a wet paper bag – he is too soft and his feet are too square.

My response: That’s a contradiction. If a generator is running, at least some electricity exists since the whole point of a generator is to take fuel and convert it to electrical output. They have electricity, just not as much as usual. Boo-hoo.

It’s also interesting that he chose “33 degrees” as the number, which is very fishy.
It’s fishy because it’s just one degree above the temperature at which water turns to ice (which means he’s probably LYING since one degree colder and they’d be living with icicles and drinking ice cubes).
It’s rather CONVENIENT that he chose the coldest temperature possible right before water turns to ice, since just one degree colder and he’d be exposed as a lying sack of shit because internal water would freeze below that temperature. This guard is probably a bleeding heart.
*But even if he’s telling the truth, 33 degrees is still warm enough to melt ice cream.

If not, it means somebody is EXAGGERATING.
