Agnifilo: Women had sex with Raniere ‘for many of the reasons people have been having sex since the Garden of Eden’

Marc Agnifilo continues to slam the government in his memorandum of law filed with the court seeking the dismissal of sex trafficking charges against his client, Keith Alan Raniere AKA Vanguard.

And within it, we get a glimpse of Agnifilo’s rich sense of humor as he provides the Court [and Frank Report readers] with some comedy gold.

Agniflo explains to the Court that his understanding is that the government does not have a case where they can show that any “commercial sex acts” took place. All they can prove is that “sex acts” took place – and that’s never been illegal.

Indeed, as he points out, it’s not unique to the women of DOS. People have been committing sex acts since they first got together in the Garden of Eden. And, as in the case of Raniere with his DOS slave women, they were having sex for the very same reasons.

Agnifilo writes:

“The most glaring deficiency with this Indictment relates to its abject failure to factually allege a “commercial sex act.” …

“As to the sex trafficking charges, the statute uses terms such as ‘force, ‘threats of force,’ ‘fraud,’ and ‘coercion’ as well as ‘commercial sex act’ which are susceptible to a wide variety of interpretations and meanings and therefore requires particularization in the charging document.

“This is especially true as to the term ‘commercial sex act’ where, as here, the Government conflates social benefits allegedly related to a sex act such as ‘status,’ with economic benefits such as money or things of economic value.

“Most troubling, however, is the fact that the Government has sound, though unconstitutional, reasons for keeping this allegation as vague as possible.

“Plainly, there was no prostitution in this case, nor was there anything resembling sex for money, or sex for fame as an actress, or sex for the selling of photographs. The closest the Government gets to commercial sex is sex for love, sex for attention, sex for acceptance, sex for sex’s own sake—in short, sex for many of the reasons people have been having sex since the Garden of Eden.

“In sum, the Government is encouraging the Court to read the word ‘commercial’ out of the term ‘commercial sex act,’ leaving only ‘sex act.’

“At the end of the day, that is all the Government will ever prove: that people had knowing, consensual, non-commercial sex with Raniere. Acutely aware of its evidence, the Government seeks to transform a powerful, gravely punitive statute focused on appropriately punishing pimps and others who profit from the buying and selling of humans for sex into something that encompasses sex in general, without regard to the commercial nature that makes the conduct it proscribes vile and blameworthy.

“The sex trafficking counts and acts are plainly deficient and should not be part of this trial. ”

Agnifilo makes an astute, intelligent and nearly unimpeachable argument…

Well, except for a few minor holes, such as:

1) Women in the Garden of Eden didn’t have blackmail collateral being held over their heads by Adam every time he asked them to perform coitus. It’s a historical fact that Eve willingly chose to fornicate with Adam in that lush garden, without any threats of blackmail material being exposed.

2) Women in the Garden of Eden were not given ‘coach’ or ‘proctor’ status for performing coitus with Adam. Whereas in NXIVM, it’s hard to find a woman with a Green, Orange or Yellow sash who didn’t fornicate with Keith. These same women also earned more money than the white sashes who didn’t fuck Keith. Women within NXIVM who fucked Keith seemed to be better off financially than women who didn’t. Coincidence? Yeah sure.

I’m sure that Frank could write an article examining the percentage of women with Gold, Purple, Green, Orange and Yellow sashes who were also fornicating with Keith. That number might not be “100%” but I’m sure it’s damn close to that. Did the women who never fucked Keith make the same money within NXIVM as the ones who did fuck him? I’d like to see Frank write an article examining this in more detail, woman by woman, sash by sash.

3) In the Garden of Eden, Adam was a handsome man with a great physique while strutting around in his toga, which is why he didn’t need to hold blackmail material just to get laid. Whereas Keith is a short and pudgy little fraction of a man, with a geeky appearance and square feet. Very few women would voluntarily choose to fuck a short, pudgy and geeky man. This physical difference between Keith and Adam is likely why Keith requires blackmail collateral from NXIVM women. Agnifilo forgot to mention this FACT in his memorandum to the court.

Also, Adam likely possessed a foot long tube steak that puts Ron Jeremy to shame. The Bible doesn’t mention this specifically but I think it’s a logical assumption. Whereas Keith’s small & square feet probably indicate that he’s packing a more modest sized wiener than Adam had.

4) In the Garden of Eden, Adam was virile enough to seal the deal with Eve WITHOUT having to TUNE HER UP. Whereas with Keith, rumor has it that his flaccid noodle is preventing him from achieving full release during coitus. This is why Keith invented the “tune up” where he simply eats a woman’s pussy and then jacks off on her titties using high speed masturbation. A real man doesn’t need to “tune up” a woman. A real man can get wood during fornication. Agnifilo’s memorandum doesn’t seem to mention this FACT, though.

5) Adam never required the women in the Garden of Eden to grow full bush pussies. Yet Keith does require this. Apparently Keith believes that a pussy with a full bush of hair will release lots of “pheromones” and thereby allow his limp noodle to become at least partially stiff. Agnifilo is ignoring the FACT that Adam didn’t force Eve to grow a full bush on her pussy. Adam didn’t need the extra pheromones to get erect like Keith does.

I hope the government files a response to Agnifilo’s memorandum to address these issues with the court.

What Agnfilo leaves out is ‘COERCION’. Pressure was put on others to deliver the goods. What he also fails to account for is the definition of forced sexuality has changed in the last 2 decades. Civil protections have been put in place to protect vulnerable populations including children and those in work relationship.

I found out the other day that one of the sororities at my alma mater required the female pledges to blow a guy in order to become full members. Obviously the leaders of the sorority were never charged with sex trafficking, but isn’t it quite similar? Agnifilo kind of has a point about the definition of “commercial”.

Don’t get me wrong, DOS still sounds scummy, and so does Raniere, but to be a pimp, he would have to actually sell sex. Same reason Harvey Weinstein isn’t really a pimp.

The leaders of that sorority could face expulsion and legal charges. Forced sexuality is now a crime as the social definition of coercion and rape have changed in the last 2 decades.

I was pimped out to Keith and it greatly affected my position and pay with the companies. Any woman who was in NXIVM for a few years or more and moved to Albany knows you couldn’t turn Keith down and expect to ever make money again. For the haters on the blog who might be disguted by me, know that by the time this happened I was tens of thousands in debt, lost all my former friends and family because I had condemned them for not being “integrated” enough, and worst of all Keith’s pimps and the leadership of the group had psychologically crushed me into oblivion. My confidence, my ability to reason were in the toilet. Agnifilo and all the other NXIVM flying monkeys can say there was no “commercial” sex acts till they’re blue in the face. It doesn’t make it so. NXIVM and all its related entities were businesses. Plain and simple. All these DOS women were dependent on the NXIVM entities for their income and survival. Plain and simple.

I’m not going to address the sorority example because it’s not on point. I’m writing this for the victims who read this blog. And for myself. Yes, this happened to us. What they did to us was criminal. We are crime victims.

Recovery is a slow but necessary process. It is important to tell your story over and over again. Here and to anyone who is patient, concerned and will listen deeply. I’ve made mistakes too. I’ve trusted when I should not have. I’m in the same process right now.

It takes strength to rebuild one’s life. Speaking up helps as does getting love and support from others. If you’ve burnt bridges ,they can eventually be rebuilt as you’re ready to take the risk to make amends to those you’ve hurt.
