Marc Agnifilo has been acting consistently more shaken up as time goes on.
He writes strange things in his legal filings like a nervous man, says strange things in the courtroom like a nervous man, and has acted consistently more bizarre as time has progressed — almost as if he’s trying to signal something he can’t overtly say to the outside world.
Why are all of the defense lawyers so adamant about insisting only the judge views details about the trust arrangements, not prosecutors?
Why would it matter, considering how everyone already knows Clare Bronfman’s money was involved with NXIVM’s legal fees? Is there concern that a top figure in NXIVM’s management structure might be charged in a superseding indictment if prosecutors were to see all of the details pertaining to the trust?
Was the trust funded in whole or in part from one of the “complex” offshore jurisdictions, such as BVI, Cayman Islands, or perhaps… Luxembourg?
Agnifilo represents the Vanguard on paper, but who has Agnifilo really been ordered to protect and defend? Who is really behind the effort to coordinate more than twenty lawyers in lock-step who seem to be able to predict the Government’s every move, as if they were being expertly guided by the invisible hand of a former United States Attorney who knows the intricacies of DOJ procedures?
Who has the expertise to hire experts about Government procedure and meddle in Government proceedings?
Who is Agnifilo’s real “boss of bosses?” Who or what can threaten and pressure a man so brutally?
What could bring a man, an experienced lawyer who is supposedly cool under pressure, to be so nervous he’s literally shaking in his boots while invoking God in the courtroom?
We may be able to sum it all up with one word: Mexico.

So far, Emiliano hasn’t been charged, but defense lawyers continue to walk a tightrope as they hold off criminal charges against the Junior Statesman from Mexico’s most influential political family.
It must be a bummer to know you’re working for the Mob.
Try to imagine, in that hypothetical context, going to sleep every night wondering what may happen to you and your family if a “stealth client” who you’ve been paid millions of dollars to keep out of harm’s way, is indicted.
Unless of course your name is Dennis K. Burke, in which case, you’ve already been with the program for years and found “other” ways to self-medicate.
The mere fact that prosecutors are sniffing around the mysterious legal defense “trust” sure seems to have Agnifilo shaking in his boots, for reasons that imply consequences beyond possibly unpaid legal fees.
We all have decisions to make in life. Who we accept as “clients,” the complicated situation defense lawyers seem to have agreed to participate with, and what kind of dirty money we accept in our worlds, were decisions made by these defense lawyers who may have consciously decided to “look the other way” at the outset when the trust was first funded.
As the Vanguard himself is certainly starting to learn by now, decisions have consequences, even when they are made by the Smartest Man in the World.
Defense lawyers: Do you know who your real clients are?
As for Burke and his cronies. They are utter scum.
What is it with the legal community in Arizona that creates monsters? Like Andrew Thomas, the county attorney who believed he was above the law, Burke should be disbarred.
Burke has already been sanctioned by the Arizona bar and is a persona non-grata in corners of the legal community.
No one is above the law.
Not “Vanguard” with his long list of crimes.
Not “Legatus” with her abusive litigation intended to destroy others in court.
Despite what he apparently believes, by virtue of his historical conduct, Dennis Burke is not above the law either.

The truth about Burke has been exposed. Obstructing justice is illegal. Intimidating witnesses is illegal. They should be prosecuted. He should be prosecuted. When will he be appropriately charged and convicted?

Agniflio is having his own trial by cognitive dissonance in his court of conscience, because he has one regardless of how far he had to bury it to do something so utterly repulsive as using exposing his teenage daughter to a pedophile who probably thinks she is his type.
Sigh. Frank, you are doing a great job reporting, and this seems to be the only place on the net to get case updates, but I just can’t read the comments anymore. What is wrong with commenters that they have to bring politics into this, and call people names?

These people he could be afraid of are not above threatening families, gathering collateral, they could have had PI’s gathering info on all the attorneys. Clare herself has gathered such info on judges etc…, the difference is this time they won’t get away with it. Aggie is also parroting KAR which would make anyone look batty.
Perhaps you are correct as to the reason for Agnifilo’s strange behaviour lately. The recent eccentric bail application for Raniere made me wonder how many opportunities Vanguard has had to try to influence, or attempt to hypnotise his attorney. I believe Agnifilo claimed that the bail application was written by Agnifilo himself even though a portion of it would have passed for Raniere’s words. In the UK a defendant can plead not guilty by reason of diminished responsbility, I don’t know what the US equivalent is but would Raniere try that defence and what would happen if he did?
I’m not aware of the term “diminished responsibility” in the U.S. legal system. Criminally insane is the closest similar term, and that is a very high bar. I doubt Raniere could qualify, because he’s too lucid to be insane. Also, his supposed genius status makes criminal insanity even more difficult to achieve.
No doubt you are correct Scott. Maybe Allison Mack would stand a better chance with this sort of defence though.

Wouldn’t it be ironic if Agnifilo ends up going to the feds asking for protection from NXIVM/Bronfman/Salinas? Does anyone think any of the law firms involved will wake up to reality and notify the feds if they suspect legal fees were paid from proceeds of Mexican money laundering, carefully “placed”, “layered”, “integrated”, routed through nominees or “prestanombres”, then paid out to law firms through a “trust”? Like the post says, Defense lawyers: Do you know who your real clients are? Google is your friend. The relevant PBS FRONTLINE article is titled “Family Tree – Carlos Salinas | Murder Money & Mexico”.
Lawyers don’t care about that stuff, they have a nose for the money and that’s all.

Frank’s words are exactly applicable to how I have viewed Amway and other MLM scams since 2005. He’s just been more effective at exposing NXIVM than I’ve been exposing MLM scams.
There could be multiple strings being pulled, and they may or may not be pulling in unison.

Hillary Clinton just got some bad news. A judge has reportedly ordered both the DOJ and the State Department to reopen part of the Hillary Clinton email investigation.
Here’s what we know:
•CHICAGO TRIBUNE – U.S. judge ordered the Justice and State departments Thursday to reopen an inquiry into whether Hillary Clinton used a private email server while secretary of state to deliberately evade public records laws, and to answer whether the agencies acted in bad faith by not telling a court for months that they had asked in mid-2014 for missing emails to be returned.
•The order risks reopening partisan wounds that have barely healed since Clinton’s unsuccessful 2016 presidential bid, but in issuing the order Thursday, U.S. District Judge Royce Lamberth said the spirit of the Freedom of Information Act required it.
•In a narrow but sharply worded 10-page opinion, Lamberth wrote that despite the government’s claimed presumption of transparency, “faced with one of the gravest modern offenses to government openness, [the Obama administration’s] State and Justice departments fell far short” of the law’s requirements in a lawsuit for documents.
“Fell far short” is a major understatement. The Obama administration was never the ‘transparent’ government they claimed to be and they intentionally misled people about Hillary’s private email server.
•Conservative legal watchdog group Judicial Watch filed its FOIA lawsuit in July 2014 seeking State Department talking points issued after the September 2012 attacks on U.S. facilities in Benghazi, Libya, that left the U.S. ambassador dead.
•The suit came months before news broke in March 2015 that Clinton exclusively used a private email account as secretary from 2009 to 2013.
•Between July 2014 and March 2015, the State Department said in court filings that its document searches were adequate and did not mention unsearched records as it, proposed to settle the case. The agencies later acknowledged that additional searches would be needed, without disclosing that it had received 30,000 emails returned by Clinton.
•At best, Lamberth said the government’s actions reflect “negligence born of incompetence,” adding, “At worst, career employees in the State and Justice departments colluded to scuttle public scrutiny of Clinton, skirt FOIA, and hoodwink this court.”

It’s not about Trump, it’s about the fact the Hillary had deals with all the corrupt officials that have so far been removed from office, she’s one of the bad guys. And this case would have quietly disapeared , she knew to many of the corrupt and would have found a way or I’ll say tried because Frank may have still been able to keep attention on Nxivm, but you can bet Hillary would have had her people working on it.
But be sure if Trump does get involved he will accomplish something.
Normally, I wouldn’t respond, but in this case, I will make an exception.
Trump sent Kushner to Mexico, and the Mexican newspapers clearly credited Kushner with Raniere’s speedy and without judicial process deportation (a.k.a. dumping over the border to the FBI).
So while what positive things in America under their current administration may be up for debate, Trump via Kushner significantly contributed to justice in this case.

If you are interested in researching for yourself I would take a swing at searching for NXIVM Raniere Kushner viaje de mexico. I know I saw it in more than one article.
Obviously, it was a very small part of Kushner’s Mexico discussions, but it was a gesture of good faith on Mexico’s part to show they wanted good relations with Trump admin.
It was all rave reviews for Kushner in Mexico, so I wasn’t surprised at all when he was given the Order of the Aztec Eagle.
