Kristanna Loken’s lawyer threatens to sue — I keep story posted nevertheless

Taking a page out of Keith Raniere’s playbook, actress Kristanna Loken has threatened to sue me unless I take down a story I published about her.  That story is “Terminator 3 Star Kristanna Loken revealed as part of NXIVM – Raniere may be her baby daddy”

In the story, I asserted that, according to sources:

1. Loken is a staunch Nxivm follower.

2. She attended Jness Track #11 in Albany in October 2017.

3. She stayed with DOS slave Vany Huber in Clifton Park, a few doors from Keith Raniere.

4. When she first met him, she had sex with Raniere in his sex lair.

5. About nine months later, she gave birth to a son named Thor. She has not revealed the identity of the father.

6. Raniere claimed to followers, Loken had sex on the first night they met and loved to tell polyamorous stories about her.

7. Loken appears in an online video endorsing Raniere’s teachings.

8. In her video, Loken says, through Raniere’s teachings, she “found out who and what I am all about.”

9. Alleged sex-trafficker Allison Mack appears on the same website endorsing Raniere.

Three days after I published the story [April 7, 2018], I received an email from Jordan D. Grotzinger of Greenberg Traurig [one of the world’s largest law firms]. Here is the PDF of the letter

RE: Loken v. Parlato, et al.

Dear Mr. Parlato:

This law firm is litigation counsel to Kristanna Loken. We understand that you own and/or control the websites artvoice.com and frankreport.com, which published false and defamatory information concerning Ms. Loken in articles dated April 7, 2018.

We demand that you immediately remove all references to Ms. Loken on your websites and cease and desist from making any future false and/or defamatory statements about Ms. Loken in any forum. In addition, you must confirm in writing by reply to my e-mail within 24 hours that you have done so.

The false and defamatory statements against Ms. Loken include, among other things, (1) statements alleging Ms. Loken’s participation in a “sex slave cult,” (2) statements that Ms. Loken attended an “advanced secret women class,” (3) statements regarding the identity of the father of Ms. Loken’s child, and (4) various false accusations regarding Ms. Loken’s sexual history.

The apparent purpose of these articles is to drive traffic to your websites through “clickbait” by defaming Ms. Loken.

Your false statements constitute actionable defamation of Ms. Loken, and were plainly intended to harm her reputation and business in the entertainment industry.

This matter is of serious concern to our client. There is still a chance for you and your businesses to avoid costly litigation and a substantial judgment against you. You and your companies, agents, representatives, affiliates, and all others directly or indirectly involved in the posting of defamatory information must immediately and permanently cease and desist from any and all such further conduct and remove all references to Ms. Loken from the websites you own and/or operate. Specifically, pursuant to California Civil Code § 48a, our client hereby demands that you immediately and permanently cease and desist from any reference to Ms. Loken on artvoice.com, frankreport.com, or any other website, location, forum or medium under your control. Moreover, as mentioned, you must confirm removal of the offending material within 24 hours from now, by reply to my e-mail.

Unless you take the steps referenced above to remove the false postings and cease and desist from publishing false, misleading, and damaging materials concerning Ms. Loken, we will seek appropriate relief in court against your companies and you personally. I assure you that you will deeply regret any noncompliance for a long time.

Ms. Loken reserves all rights and claims, including, without limitation, those regarding any proliferation of your defamatory articles, which is more likely to occur the longer the defamatory content remains online.

Naturally, I do not want to publish false and defamatory information. Neither do I want to “deeply regret any noncompliance for a long time.”

So, I double-checked with sources, spoke with new sources, and updated the story with more information. Some new information I uncovered I withheld so as to not further embarrass Loken.

I then called Loken’s lawyer and informed him I would keep the story up.  He said he would sue.  I said I look forward to discovery. He said it would cost me a lot of money.  I said he might check with his client – for she may not be telling him the full story. I kept the story up. I have not been sued – yet.

So why write about it now? 

Before the lawyer’s email, I was not planning to write more about Loken. Still, her attempt to silence me, [Raniere-style] should not be answered with “compliance” but defiance. It requires putting her threat of a lawsuit on the record.  When and if she sues, I will also post that information on the website. And I will also post whatever information I obtain via discovery.

I recently published a story about an athlete who was a NXIVM member – and in the few hours it was online, it was getting plenty of traffic. He called. He did not threaten. He asked me to remove his story because it would hurt him and his family. I took the story down.  As a matter of principle, I never take posts down based on threats.

I’ve met & talked to Kristanna at 3 public events. She remembers me and my boyfriend. I doubt I’ll be seeing her again anytime soon. But if I did, I would tell her I think it’s in her best interest to focus on her family and work. She should talk to her publicist or get a new one that understands how to spin this type of bad publicity and turn it in her favor. Also the news and press is so rampant & chaotic that people will forget in a week or two most stories in general.

Kristanna Loken does not want to open herself up to being deposed (where you can have her say under oath who her baby daddy is, did she have sex with him (oh course, you will have to define what you mean by “sex with him” or other male members of the sex cult.

There are others questions to be asked in a deposition and on the stand (under oath to tell the truth)

Dear Mr Grotzinger, your best advice to your client would be to back off a lawsuit, save the money she is paying an attorney for her son as he is her most important concern I hope. Lawsuits just bring out more dirty laundry . If these women that have been so used and abused by Keith want to sue somebody and actually do something useful they need to accept what he has done to them and make him pay. This will haunt them for the rest of their lives. Kristanna your info is already out there, you can’t change that, I will pray for you and your son. The child is innocent

He does get points for a subject line reading “RE: Loken vs. Parlato, et. al.,” designed to try to make you afraid that a suit may have already been filed. However, he’s clearly not putting forward his best work, as the bulk of the letter is fairly formulaic and doesn’t have the really incendiary and original content that most such letters have. The gold standard is a highly personalized letter from either Bert Fields or Marty Singer, legendary entertainment lawyers, not some guy who does a bit of entertainment law for a huge legal conglomerate.

Suing under California law (Grotzinger is based in LA, as is Loken) would be an especially bad idea, since California’s anti-SLAPP law, which provides for easy recovery of costs in a lawsuit of this sort that’s designed to suppress free speech on an issue of public interest, is one of the oldest and most thoroughly litigated in the world.

The article merely states the fact that Loken was involved with NXIVM, which contained a sex cult within it and asked questions about the paternity of Loken’s child, who was born out of wedlock with an unnamed father.

hmm Naturally, I do not want to publish false and defamatory information. Neither do I want to “deeply regret any noncompliance for a long time.”
That’s not all true. It’s clear and obvious to everyone who reads your website that you are cool with publishing defamatory information. Sometimes,you describe it as another way to deprogram those who are still in it etc. Your stories have tended to be very salacious at times and so I don’t find the lawyers’ assertion about you to be entirely false. It’s also not a page from Raniere’s playbook, because he would send letters to shut even those who did their best to not defame others and were only trying to bring light to the issue, unlike your approach. So while I think it’s shitty that Raniere and Clare came after you when you were supposedly helping expose how Clare was being defrauded by Raniere, what you experienced is nothing similar to what all the women have experienced. A lot of good has come out of your approach as well, with regards to exposing what Raniere has been doing, which is much appreciated.. at the same time, I still wish you could be more mindful and human in your approach. For what it’s worth, listening to you on the radio or watching you on a video is much better than how you write about stuff. You come largely come across as sensible when you are not simply writing.

Since the letter states that Frank is not to publish FALSE AND DEFAMATORY information, and he is publishing the truth , then he has nothing to worry about. If the has published the truth, and Loken decides to proceed with the lawsuit, she would need to prove the information published was false or libel. You can’t win a libel suit because the truth was published about you, and the truth makes you look bad.

Loken’s lawyer will need to investigate the matter prior to taking the case (which he has not done);he just sent threat, and I wonder if he will be willing to take the case following his own investigation?

Would he take the case knowing that Frank hasn’t lied about Loken, and Frank has the evidence to prove his claims?

Anonymous- do you believe that people can do whatever they want, but when they are exposed to have behaved in a way that is unacceptable/unethical/criminal, that they then have a right to sue the party who exposed their unacceptable actions?

You may think it is “shitty” that Clare and Keith came after Frank, but how can you honestly say that what they did to him was not as bad as what they did to those women? The letter actually demands that Frank cease any mention of Kristianna Loken AT All.

In other words Frank would agree not to even make a statement like “Kristiana Loken has been cast in the new Arnold Schwarzenegger movie “Terminator 7”.
Such a blanket prohibition of free speech is an unconstitutional prior restraint of speech unprecedented in US history.

Ye’s ..that is an interesting point. What person thinks that they have the right to DEMAND that their name not be mentioned, at all. Has anyone ever been able to enforce such a demand before? I understand why the lawyer did what he did- billable hours, he’s going to humor the idiotic Ms. Loken to pay for a trip to Bermuda or somesuch. It’s Loken who is the shortsighted moron- she has gone full “Streisand Effect”. I used to publish hundreds of stories on web sites, and would be ecstatic when receiving letters like these. When I got these types of letters, I knew I had something hot, and would make sure that particular story got extra exposure and distribution. Lawyers provide a free feedback mechanism to tell the world “EVERYONE LOOK HERE AT THIS!”
